My mothers checking account was frozen over my debt, HELP!!!

About 3 years ago I attempted to start a business as a mortgage broker and ended up in financial trouble because of it. To make a long story short Florida got hit with a few hurricanes and in 6 months I was financially sunk. I didn't owe too much but at the time 6K was more than I could handle considering it was spread out over a few accounts and each were whacking me with $75 late and overlimit fees. I tried to explain the situation to account holders, and went back to college to prevent something like this from happening again. It seemed like a good idea when the cost of living plus bills would keep me in a forever debt. Eventually I stopped answering creditor calls and understandably they didn't want to wait until I was in a possition to pay them. So now I'm getting ready to graduate at the end of the month and can get a job that pays enough to live and work on clearing everything up. I got a frantic call from my mother this afternoon saying that she just got a letter from the bank saying her account was frozen. She's on disability and added my name to her account for emergency purposes, which I didn't know about. I was never contacted about a court date and the account isn't mine. I understand that I screwed up, but I can't let my mother pay for it. I've been living on Ramen noodles for the past 2 years trying to keep up with tuition, and a roof over my head so I really don't have a lump sum to offer. The accounts that had a balance of about $1500 each have all skyrocketed and the one judgement is for 6,000. Now I owe almost 20k and am hoping that I can work out some kind payment plan for more reasonable amounts, but I need to fight them about my mothers accounts? She didn't do anything wrong and I need to clear this up as checks are going to bounce and its the account that her disability is deposited to. Please help me, I need advise!!!


I agree, she should stop the direct deposit of her disability check immediately and have your name removed for the time being. There are other ways she can have you take over her accounts if she should need you to in case of an emergency, such as a living will etc....

They can not garnish disability checks, but there isn't anything stopping them from levying the account. That is two completely different things, and she should definately stop the direct deposit.
