i received a letter from them stating they will forward my documentation to a collection attorney in my area within 21 days if i do not respond to them. does this mean they are going to sue me?


OK have you ever gotten anything from them in writing? What state do you live in? What is the debt for and when was the last time a payment was made?

This company is based out of Canada and are idiots so beating them is pretty easy. Do not call them. Most likely they are bluffing but either way they can't do a thing to you anyway as they are not in the USA.

If they do forward it to an attorney in your state then they must send you a dunning letter. You then have 30 to dispute the debt. In most cases if you fail to dispute, then they can sue. Usually small claims summons are either mailed, depending on state and if it is a civil court case, a sheriff serves you. It can take up to a year before a case goes to trial so if you do get sued, play your cards right and answer everything correctly. You will have plenty of time to file bankruptcy, even if you are in litigation, once the bankruptcy starts, all lawsuits stop,well depending on the type of debt, but in general credit cards or consumer debts.
