Please any help would be appreciated, I used this website years ago when I first was being sued prior to my bankruptcy and it really helped me ALOT and I would be so great full for any information you can give me about my situation. sorry in advance for the long post!
I have received a letter from GEM financial stating they will sue me for an unpaid debt. I called to find out what credit card company the original debt was from and the guy on the phone said it was from a chase credit card that was opened in 2003. I filled bankruptcy in 2008 and was given a discharge in 2009. At the time of filing my list of creditors , chase was still on my credit report and no other collection agency was on there regarding that account, BUT there were collection agencies listed in the inquiry section.
When I was talking to the guy from GEM he said I could call chase and verify the account, but I asked him who they bought the account from and he said GL recovery and then got snippy with me about settling my debt with them before they take me to court and I said I would have to check my records and get back to him but he kept getting crazy with me , eventually he put me on hold and I hung up.
I called chase and their credit card recovery department was closed so I talked to another c.s. rep and they directed me to their collection department ,the recorded information stated that the account was sold to UNIFUND collections. so now I have no idea what to do..?? since I listed chase on the bankruptcy and they are the orignal creditors.. does my discharge cover that debt OR since none of credit reports listed GL recovery, UNIFUND or GEM as having bought the debt and since I didn't list any of those companies on my list of creditors, can GEM still sue me for that debt???

They blowing hot air. Send them a cease and desist letter in writing including your bankruptcy information. They are in violation of the BK discharge. Stay off the phone.
