I live in florida and I have a wage garnishment, but the debt is on a car loan from 6 years ago and the loan was originally signed in arizona. I tried to have them take payments plans but they took out the garnishment from my pay check so I could not make that first intial payment the I have promised them. Can they sue me?


yes they can do that..however, did you live anywhere near the residence in arizona when the case was filed? Pull your credit report, it will have the date of filed for your judgement on it. you can get a free credit report at annualcreditreport.com..check your dates..if you were not residing in arizona at the time creditor filed suit, then you may have permissible grounds for vacating the judgement against you due to improper service. check your credit report first..you may want to contact the courthouse inwhich case was filed to get a copy of the court action against you..hope this helps..sorry for the length..
