Check this out - this is EXACTLY what we see with payday lenders every day. Apparently some bottom-feeding foreign collection agency has gotten a hold of consumers' SSN's and phone numbers from IPDL websites, where the consumers borrowed (and repaid) years ago and they are now pulling the scare tactics we see all the time - jail time, "downloading affadavits", sending you to the legal department, etc.

Don't fall for this, folks.

The interesting thing, to me, on the "comment" thread of the ABC story, is how people feel it's so easy to just hang up on these people, and presume they'll go away. It's like a whole sub-culture of bottom-feeders that people don't know exist.

This guy called me and stated that he was Officer Wilcox or something like that and I called him back and he claimed to have recorded me stating that I would repay him. He also told me to fax him my debit card information and that I would have to call him every single day and that I could not miss a day and that if I did he would turn me into the authorities and I would be arrested and jailed for six months and he did not know what else they would do to me and that my social security number was blocked by the United States Government for some silly fraud activity. I must admit that it really scared me but after reading all your posts and comments I feel better knowing that this is a fraud and I will turn the tables on him the next time he call and let him know that he is being recorded and I have my attorney right here with me and I will trace his calls and have him arrested and see how he likes that. What do you guys think? Is this fraud or what because I must admit that it really ruffled my feathers.

In the last 2 months, some supposedly, legal team that is going by the name Morgan and Morgan is continuously calling my job 4-8 times a day. I am getting in trouble for them calling so much. I have asked them to send me something by mail if I owe them, but they just refuse and continue to call my job. They threaten to throw me in jail over a loan that I had from 3 years ago and I had repaid it. It is not even on my credit. What do I do to stop them from calling my job? I have threatened legal action and my husband had cussed them out, but they still call.

I think their home office is in Fla., but they have offices in several states, try to obtain the address of the office that is calling you and send them a DV letter and a limited CD letter advising them to contact you by US mail only, send these by CMRRR. If you have proof that you paid the loan, then send proof of that as well. BTW they can't throw you in jail for a debt.

The best thing you can do to keep them from calling your job is to get your supervisor involved. I know that sounds like a horrible thing to have to do, but to be honest and upfront with them is the best thing to do. Have a private meeting with your supervisor and tell them that you had a hard time financially a few years back, and you took out a loan from this company, and then found out later they were operating illegally in the U.S. You paid off the loan, and are now being threatened by this company with jail time,etc - which they can't do - and you need some help getting them to stop calling. See if your supervisor will work with you on it, and can get the switchboard or whoever answers the phone to just keep hanging up on this company when they call.

I know that seems like a drastic step - involving your supervisor- but it worked in my case - Rt. 66 was calling my workplace TWO YEARS after I took out a loan with them and paid it back. I had my supervisor and HR director sitting with me when they called, and the HR director put the guy on speakerphone so we could all hear it. He said I owed $4000 on a loan of $250 from 2 years ago, because I hadn't paid it, and was the HR director going to pay it for me??!? These people are nuts, and will do just about anything to try and get your money from you. Don't fall for it. Play hardball with them if you know for certain that they are trying to scam you in this manner.

    when they threaten to send their 'legal team' after you, tell them to go right ahead. In fact, do them one better and tell them to have their 'legal team' meet you at the state police post in your area, give them the address, and tell them that you'll meet them there with a legal team of your own, including the police, reps from the BBB, the state's attorney general's office and your own attorney.

    when they threaten jail time, tell them you'd love to share a cell with them, since they will be there too - for operating illegally in the US and making threats that are against the fdcpa.

    when they demand thousands of dollars for an old loan of merely hundreds, tell them they'll get payment as soon as they send you a copy of the contract you signed (you didn't, it was probably over the phone or internet), proof of the payments you've already made, proof that they actually have a 'legal team' and their names, office addresses and copies of their liceneses to operate in your state, and proof that you owe this 'thousands of dollars'.

Netb, make sure that the law firm of Morgan & Morgan are the actual ones calling you, they are a large firm, but I never knew they dealt with collections; in fact their website states that they will help if you're being harassed by CA's.

I honestly think some of these places steal names of actual law firms and pretend they are working for them. That is why when you call them they never say the actual company name. In my case the one I'm dealing with always answers just plane ole "Law Firm" or "Legal Dept."

Like the guest above said, make sure it's the actual Morgan & Morgan calling you. Maybe you could call the actual one and say. "Somebody called you from this office and you need to speak to whomever is handling your account. If they can't find anything then you know whomever is calling you is full of crap and you can let the real Morgan and Morgan know that somebody is using their name. If they do pull up something then you can file a complaint on them for harrassment.
