Help with Frederick Hanna and Georgia Law

Just received a dunning letter from Frederick Hanna claiming to be on behalf of Capital One. The acct was last paid in 6/ 2010. The last calls we received on this account were coming from Nelson & Watson. This is the first I have heard of Hanna.

I read on another forum where people had judgements against them because they claim they were never served. Seems suspicious but he appears to be scum. I moved to GA less than a year ago. How can I learn about GA rules for debt collection and legal notices? I live 3 hours from Hanna's offices. Can they sue me in the county they are located? Or are they required to sue in my county? I don't want to end up with a default judgement.

I will be sending a validation letter. I will also keep a check on upcoming court cases. I'm just not sure which county I need to be concerned with.


Yes, send a debt validation letter in writing to them first. Since you are so scared abut judgment, so you can contact the county court clerk and know whether or not any case has really been filed against you. It is difficult to say as to where they will sue you. There are instances where collection agencies have sued consumers outside their county.

They will have to sue you in the county you live in. If you got a letter from Hanna send that dv letter. Hanna will respond with a generic we say you owe us so pay us response. You can be 90% sure they will file a lawsuit if you don't offer to pay them cause they file hundreds of suits a day looking for people that will ignore them so they can win. In GA you have 30 days to answer their summons if they do try and sue you. They don't like to travel outside their comfort area so if you don't give in with out making them prove that it is your debt you can probably win against them. Just make them prove they have all the documents and proof that it is your debt.
