I read some of the posts about Fred Hanna and wanted to know if there is any updated information on them. I received a notice that my credit report was accessed by them recently so I am wondering what to expect next. I have never been contacted by them previously, but I am disputing a debt with Arrow Financial and they recently told me that they were going to send it to legal if I did not just settle with them. I am guessing this is what Hanna accessed my reports for. I have records where I sent registered letters to Arrow asking for complete validation of the debts and asked that they not contact me anymore by phone. Started back in April, they never sent me validation, then again in August I sent another request for validation. Any insight would be helpful. If they are going to take me to court, then I want to be prepared in everyway.


Yes, thats what I recently read, but evidently the company that had the account prior to turning it over to Hanna was Arrow Financial. They reported the account as open and current even though the last activity on the account was in 2001. They continued to report erroneous data to the credit bureaus in an attempt to re-age the account. I contacted all three bureaus and they informed me that I had to to contact Arrow directly to get them to correct it. Even though I never admitted to the debts or made any payments, Arrow continued to report the account as new each month and now its at Hanna.

Are you referring to the Date of Last Activity when you are saying they are reporting the account as new? DOLA has no bearing on SOL or reporting period but is more deliberate credit poisoning. It shows as recent activity and will bring your scores down but unfortunately, they are well within their rights as data furnishers to give monthly updates on their tradeline. Is it showing as collection or installment on your reports?

Equifax told me that the DOFD was September 2002. I just hung up the phone with them. However, they are stating that the account was just recently reported as new and current, but deliquent and this is hurting my credit score. I was just able to purchase a home with a good interest rate, but I am fearing now that this guy might try to take my home or even worse garnish my wages which will make me unable to pay for my home.

The OC has reported the account as Charged Off/Sold. The last payment they received was Jan 02 and they reported it then for charge off. Eveidently, it was sold after that point to Arrow I am guessing or some other collector and eventually it got to Arrow. Arrow is reporting their tradeline as August 2008. Just looked at my other two reports. The account is only showing on Transunion and not Experian.

OK, so the OC charged off the account in 01/02. That would put the DOFD 180 days prior to that. Did you ever pay anyone other than the OC? Call EQ and TU back and ask for the DOFD reported on the OC's TL. If that date is different than Arrow's, then they have re-aged the account and are in violation of the FCRA.

Thanks, I will do that now. I appreciate the help. I just called my wife and informed her of what is to come with this agency, Hanna Law Firm because of all the things I have read about them. Being here in Iraq, serving and fighting in this war and having to fight this war with this law firm is going to be difficult and stressful, but I hope things work out. Thanks again for your advice.

Ok, so just got off the phone again with Equifax. The DOFD as reported by the OC is 02/2002 and the date reported by Arrow is 06/2002. They are telling me that the Date Major Delinquency First Reported is 07/2006 which is what they go by when it comes to SOL, so even then, I have until 2013 before the account falls off my credit report. Is this true? She went on to state that Arrow also continues to report the tradeline to Equifax monthly which also may prevent the account from getting old under the SOL. THis is the only negative thing on my credit report and its for $14,000 roughly. Maybe I should go ahead and re-enter into some payment arrangement so that this does not affect my credit rating any more. And with my security clearance up for review, it will become an issue as well. Now this is driving me crazy because I dont want to loose my career over this.

Date First Delinquency Reported is the date that any data furnisher provides the DOFD on any tradeline they have reported to any of the CRA's. It must be reported w/in 90 days of the opening of the tradeline per the amanded FACT Act. It has no bearing whatsoever on SOL! SOL is measured from the date of last payment PERIOD! Federal Reporting guidlines are very specific. They can report for 7 years + 180 days from DOFD and not 1 minute longer.

Since you are deployed, you are offered an additional measure of protection under the Ammended Soldiers and Sailors Relief Act(can't remember the exact name at the moment) and no legal action can be taken agaisnt you while you are deployed. My wife finally received a letter from Hanna stating the amount of the debt to be aboout $11,500 and that they wanted to get the money for the debt. It went on to state that if I dispute any portion to send them notice within 30 days. I sent notice the same day from Iraq requesting validation again for the debt from them now. Not sure what's next, but I also filed complaints with the FTC against Arrow and with the BBB against Hanna because they called and harassed my 10 year old daughter about this. I will follow up with filing at complaint with the Attorney General's Office in Georgia and the FTC as well against Hanna. Not sure what is next though. I am going to speak with a JAH lawyer here in Iraq in the next few days to send them yet another letter stating that they cannot do any court action until I return to the states because I am deployed. Someone suggested that I just pay the claim and get it over with, and honestly I am seriously considering that now because I do not want them to place a lien on my newly purchased home or garnish my wages. Is it feasible to make a settlement on the debt to see if they will accept? Or should I cease contact with them until I return to the states. I just dont want this lingering over me when I return because I would rather spend that time with my family enjoying them than in court, fighting against these people.

They also violated by handing the account over to Hanna while it is under a DV..that is continued collection activity. Definately have your wife start recording the calls, as all of them are violations just for calling and trying to collect (continued collection activity)!! I would send a strongly worded letter to Arrow about the violations and send a copy to Hanna, I would also let them know that you are talking with a lawyer over these violations. It is disgusting that they are going after your wife when you are away acting on our country's behalf and even more disgusting that they went after your daughter...if they had done this with my children boy oh boy would they regret it, because I would sue them up the wazoo...but then again, I am a bit sue happy since that seems to be the only way to force these scum to play fair.

while two wrongs typically to do not make a right.... there are no rules in dealing with frederick j. hannah & assoc. if you are smart you will fight them, which would lead to a sure fire victory buy putting them out of business.

in the meantime, should anyone care to get a little "right back atc ya" get even......here you go. amazing what you can learn just digging on the net.....

FYI: and the right ?ionable people. use this as you may.
