Question About Freezing Bank Account

If Freezing of your account is authorized by the court after judgment then you are entitled to receive a copy of the same. You can challenge Freezing of your account. Every step for challenging the order will be written in the copy.

JT, I receive SS as well; my attorney advised me to have my SS check sent to a PO Box and not have it deposited in OUR account where it can be frozen.

my wife and I have a joint account. should I have my name taken off of it? her paycheck is also direct deposited.

I understand that to freeze an account the bank must recieve a Writ Of Execution.

Is there a hearing before this happens? Does anyone know how long after a judgement is declared that the writ is usually served?

I know this is probably all BS, but I called the CA and the gal I talked to said they would not seize the account since I'm on SS because there wouldn't be any point to it.

I asked her what kind of payment plan we could set up and she said, again, because I'm disabled that anything I could spare would be fine.

I asked her if I had her word that my account would not be seized and she said I did.

I've also been calling BK lawyers about filing a chater 7. Thats 900-1200 bucks nowadays.

get that in writing JT.they got a judgement they don't want you to do anything to protect the account.maybe that's just my paranoia where these CA'S go,but i wouldn't take her word

Paul is correct, YOU have to stay a step ahead of the scumbags! Several years ago, I removed my name from our home, vehicles and bank account, Everything is now in my wifes name.
