Frozen Bank accounts

First let me say that this site is a blessing...Now onto the story.
Last month I was in South Carolina spending time with my sick father. I live in NYC. I had some cash that I wanted to deposit in my Bank of America account. I deposited the money. I later check online to see that I had TWO $16k holds placed on my checking and savings account. I contacted Bank of America about this and they told me the letter authorizing this action was sent to my home. Being in SC I was not able to get it. They also gave me the number of the person to contact that put the hold on my account.
It's a law firm in Long Island, NY.
I called them asking them what this was about. They told me about a Providian account I had and how they were trying to reach me since February. I have recieved nothing from them at all. The hold was placed on April 2, 2007.
I spoke to to people. The person handling my case was very rude. She then put her supervisor on the phone and we discussed the account in question. It was decided that when I returned home to NY, I would fax him my pay stubs to show how much I make so that payment arrangements could be arranged. That was last month. They knew I would not be home until May.
So I return back to NY the last day of April. I check all of my mail. I found two letters. One is a Restraining Notice from the Queens County Supreme Court. The plaintiff VELOCITY INVESTMENTS,LLC out of New Jersey and myself the defendant for the amount of $8000. The same amount the law firm told I owed to Providian that they are handling. So the restraining order has Velocity Investment on it only.
The second letter is from the law firm in Long Island. On this letter it states Providian v Me. It is a Notice to Judgement Debtor. They both have the same case number just different plaintiffs listed.
I also found out today from my mother that they have also placed a hold on her savings account for $4000. I am not even on my mother's account.
So I call the law firm with my mother on the phone to resolve this. The lady handling the case got very nasty and demanded I pay $2000. I calmly tried to explain to her the arrangement I made with her supervisor and she wanted nothing to do with it. She wouldn't even put him on the phone. I could easily go to their office since it's not far from where I am.
She also told me that I opened this account in 2005 which I did not. It was opened in 1998 and last reported on my credit in 2002.
How can they put a hold on my mother's account that I am in no way connected too. She also suggested to my mother that I am using her social security number.
She then went on to ask my mother about her personal finances in that account but my mother didn't tell her anything.
They won't release my hold until payments arrangemnets are made and Bank of America won't release it until they hear from either the law firm or Velocity Investments.
What are my options? I was willing to do what I agreed to with the gentleman during our first conversation last month. And this claim of contacting me is not true. This is the first I've heard from either of these two offices.
Btw, the amount I owed Providian was $5000. It is now $8k according to the law firm.


First thing I'd do would be to go to the courthouse, and obtain copies of all the documents in your case. You might want to look for an attorney, try naca.net. If you can show that you weren't properly served, and/or that the debt was illegally re-aged, you might be able to have the judgement pulled, as well as sue for damages.

JRM, What they're doing to you is awful. I really don't see how they were able to put a freeze on your mother's account if you were in no way connected to it. I would contact the court to find out why your mother's account is frozen. Maybe they can also tell you how long it would take to get the freeze taken off your accounts once payment arrangements are made. The best of luck to you.
