Intent to garnish bank account
Date: Thu, 11/04/2010 - 15:53
My wife had a default judgment (credit card debt) placed against her in 2003, before we were married and before I even knew her.
We received a letter from a attorney today threatening garnishment, asset seizure, etc etc if the judgment is not paid.
Wife's assets (primary residence) are all exempt from garnishment/seizure here in Oklahoma (I believe...).
Can this law firm get a court ordered garnishment of our joint bank account if the only funds in the account are coming only from my wages?
Also, it is required by law that we get notification from the court of any said garnishments? I would plan on filing for motion/vacate if so...?
I feel my wages should not be taken because of my wife's problem before I even met her.
Any recommendations would be appreciated!
:)

saw a show on cnbc called till debt do us part talking about people who were in debt up to more than $ 50,000.00. This lady goes out to find them and help them work out a budget for the first 4 weeks. Cut back on this and that plus find a way to earn more money to support their house. plus it shows that some folks are not paying taxes and owe them for 6 years. Is it that bad out there.
