Garnishment of Wages

My husband and I were sent a certified letter of garnishment on his wages for over 8 years ago.  When he replied to the collection agency with a proposal to make a payment arrangement they said that we had had our time and we couldn't stop them fro taking his checks every week.  We are now told to file bankrupcy on his part of the debt.  I've been told that after rufusing payment so many times that it could be thrown out of court.  I'm wondering if this is true and how could be go about getting out of a mess that the insurance company was suppose to pay.


if??you last payment was??8 years??ago and you did not commit to make payment, then you might want to check the SOL of you state, they might not be able to even sue you. And plus sending a certified letter doesn't mean anyting. they only way they can garnich your wages with with a court order or judgement.
In this letter did they say that they were going to garnish the wages?
is there already a judgement againt you/your husband?
What state do you live it?
When was the last payment made?
