Is it a violation of FDCPA if the employer garnishes wages without a lawsuit? Can a creditor do it?




Do you get a lawsuit summons? To do so, the creditor needs to sue you first.

No, it's not possible. Your creditors can't just start garnishing your wages. They must first sue you, win, and get a court order requiring you to pay what you owe.

Your credit first wins a judgment and then employer can garnish wages. Your employer also has to notify your about the wage garnishment.
