Letter from a NJ court regarding Palisades Collection

I recently received a letter from a NJ court saying that they were garnishing my paycheck for a case against me by Palisades Collections. I have never received anything (calls or letters) from palisades collections about any debt. do they have a right to go directly to garnishing pay without any actions beforehand?


Palisades should have informed you once before filing the legal case against you. Under the fdcpa laws, if you have sent a cease and desist letter also, the CA should notify you about the legal proceedings. Check with your local county if there is any legal hearing filed. This should also appear in the latest copy of your credit report.

If this court hearing has been fixed within the legal lines, show your presence at the court. Take all the documents with you and present your case in front of the judge. Tell me something about this debt and the date of last payment. I will check if Palisades is licensed in NJ and if they have the rights to file a legal case against consumers.

The letter said that there already has been a case and that they won - I never received ANYTHING from either palisades or the court about any case. also- how do i find out if they are licensed in NJ? Thanks in advance for your help!

Is it possible you threw it out considering it junk mail, especialy if you weren't expecting anyhting from anyone.

When I talk to my debtors I find that about a little over 50% throw out letters that come in a pratically blank envelope because they consider it junk mail and do not open it.

About 20% will tell you that they never got it when they did to use that as a stalling tatic but later admit in a conversation that they opened it and shredded it after reading it. And 30% will actualy own up to the responsibility.

If they already have their judgment it too late to worry about whether they are licensed or not.
