Help, being harass by Genessee Valley for debt not owe!!!

Can anyone help me please...
Yesterday evening I got a mess. from my nephew that a Mike Rush from Genessee Valley Associate called with a reference #. I called back today and was transferred to him. He got on the phone and immediately responded that I owe a debt of $5K to Bank of America. (Please note: I never had a bofa credit card). I told him that there has to be an error and this debt must belong to my brother. Since my brother and I have very similiar name and there's only 1 letter different. And I know for a fact that my brother had a bofa card. Mike said that I was dishonest and should just pay my bills. I told him that I've already taken the initiative to clean up all my debt and are working with my creditors. However, I will not pay a debt that is created by my brother. He started to raise his voice and told me to pay the full amount now! I even asked if he can provide proof of debt (cuz I know I didn't sign for any bofa credit card. He said that he's a law firm and cannot provide that. I quickly grabbed my credit report that I have with 3 bureaus on file and found that the amount was incorrect. I'm currently working on cleaning up my credit report with the 3 bureaus since they have 2 ssn # on file & all of my brother info is on my report. That's why I'm in such a mess right now. Can someone tell me what should I do, if he calls again and threaten me?

first, you don't have to take this stress because this is not your debt and the CA is collecting on the wrong person. Send a cease and desist letter to stop all their collections calls legally. If they still call after receiving your letter, you are in a stronger position to file a lawsuit against them for fdcpa violations. Send the letter CMRRR and keep a copy in your folder. This will come handy in case you take the matter to the court.

Check your state laws on recording the phone calls. When they call you, tell them that you are recording the conversation for legal purpose. They don't want to mess up after they realize you being an informed consumer. Request validation because this comes within your legal right, mentioned in the FDCPA24.

I was contacted on March 1, 2007 by these bottom feeders for a BofA debt of $12K that I don't owe. it's not even my account! I immediatly called BofA to verify, pulled my 3 bureau credit report and then started doing more and more research and found out that this is not, nor has ever been, my debt. They refused to give me their address so I could send a validation of debt request - and they never sent me the letter nor did they advise me of the right to dispute the alledged debt. I had to hire a lawer who is now in the process of filing a complaint. I live in Calif - where GVA is not licensed to do business, they have violated several portions of the Fair Debt Collections Act and are simply not interested in doing business legally.
