I live in Georgia and I have a credit card debt that is scheduled to be removed from my credit Jun 2009. A collection attorney is trying to collect on the debt. According to my CR the last date of activity was 2/2002. SOL is 4 yrs after the last activity can the attorney still collect on this debt? CR shows credit card charged off as bad debt. Not that I don't want to pay the debt I just can't afford to.

It is my understanding that once the statute of limitation is up that the debt stops them from suing you, you may want to contact the Georgia states attorney generals office and asked them this question, if the collection agency keep bothering you, you need to write a letter to them and let them know that the statute of limitations has expired and that all contact should be desceased from this point on. If they continue to contact you make a complaint with the attorney generals office as well on this matter.
