Bank account garnishment

Found out today that my checking account has a garnishment/levy placed on it. This is for an outstanding credit card dept that I do owe. Just can't pay it now, no job, no income, no savings, no personal property, just f'ing rock bottom, for now. But things could be worst. Received and signed papers/summons for lawsuit. Papers were served properly. No court date. Instructed to file with court my response. I have no response, I owe the money. CC/CA got judgement. Did not receive garnishment notice from court. Opened new checking account when I moved to Colorado hoping to fill it up from work, fat chance. I have had zero contact with collection agency. Have not filled out any paper work with my name, ss#, bank name or account number. Have not used any checks.The account balance is zero. How did they get the bank name and account number? Is the garnishment a one day event and do they have to file with the court each time. Think of starting a business in CO. It will be a partnership. Should my name be on the business account? Should the business be a LLC? Will be filing for bankruptcy. When I can pay for it. Thanks for listing.

You were already sued...there is no court hearing for the garnishment nor do they warn you in advance....that would defeat the purpose.

Finding your bank account is easy...they just send a copy of the court order to every major bank and smaller banks/credit unions in your community.

As to whether it is a one time event will depend on your state law.

How are you going to start a biz or get an LLC with no money??
