New to the Forum. Need help. Several Questions

I moved from Florida to Maine in August of 2007 (5 1/2 years ago). I had defaulted on several credit cards a couple of months before that time.

1. The Statute of Limitations in Florida is 4 years and in Maine is 6 years. Which SOL is valid?

2. I am starting to have a couple of these people call me and threaten suit. If the SOL is 4 years I am free and clear, if it follows Maine, how worried should I be (assuming that I defaulted around June/July of 2007) that they will sue me brefore the Maine SOL runs out?

3. If I can be sued should I offer a settlement and how much of one should I offer?

4. Should I ask for debt verification, proof of last payment, or anything else to help put this off hoping for the SOL in both states to run out?

I just want to make sure I do this the right way. I am trying to get my life back on track after going through an extremem financial hardship. I understand I should pay what I owe, but at the same time, if the SOL runs out I would rather concentrate of anything still within the SOL.

Any advice or help would be greatly appreciated.


In your case, the Florida SoL would be applicable because Maine's borrowing statute would prevent the CAs from from using Maine's longer SoL (as compared to Florida's) against you. If they try to sue you (and they might), this is going to be your main line of defense. I believe you should send them a C&D letter via CMRRR and shut them up.
