HELP! Received a SUMMONS, RE: GMR Credit, LLC
Date: Tue, 11/25/2008 - 12:45
OK, what do I do? I CAN NOT afford a lawyer, not at all! This is for my husband. Here is some info:
-We live in New York.
-We received a copy of a summons. Plaintiff is GMR Credit, LLC and the original creditor is Citibank, USA Circuit City. Summons states it’s from March 2006.
-He called and verified with the court clerk that this is an actual summons.
-With this summons was a letter from a law office stating that they “have been advised that service of a Summons and Complaint in this matter has been properly served pursuant to the Rules of the Court. An additional copy of the summons and complaint are herein enclosedâ€Â. This is the first time we were notified, haven’t received the summons before this!!!! Court Clerk had no idea what to tell him!!!
-This summons and letter came by regular first class mail, didn’t have to sign for anything.
-Up until now, I have never heard of GMR Credit, never received documents from them. They are not on his credit report, not even as an inquiry. Some other company was originally trying to collect (the company name is escaping my memory as of now, will check when I get home) and I DV’d them but did not get a response.
I know he has to respond in court, and we definitely will. But how and where do I begin? What is the procedure? Again, we CAN NOT afford an attorney! We have an outlined budget for the next six months and all I with have as extra money is about $50 a month because we are paying off other bills and a repossessed car. At the end of this month, we will have $200 from selling off a few things but that is to buy Christmas gifts for our son.
I believe I have to draw up a document and address each of their numbers but I don’t know how to answer.
If someone has been through this and is willing to help, it would be appreciated!

Thanks, I've read all that but it doesn't tell me how to answer. I know I go IN to answer, but what I mean is do I draw up documents before hand? Can I write up documents, or does a lawyer need to, etc. How does my document need to be formatted? I've googled for stuff, but keep finding sites you need to pay for templates.
Was I even properly served? I never received the original summons!
I have no clue who this company is, and never received documents from them. Another debt collect was originally collect on it, and I had DV'd them during the summer but they never responded. This other company- GMR Credit- I never heard of.
Bump. Does anyone know? Do I draw up documents before hand, or
