That's just a tactic Tweety. I would have said , "so what?" if he'd told me that. Not to mention, if you are in Texas, I believe they would be rather limited in what they could do even if they had a judgment.

Send them a partial cease communications letter telling them that you will only communicate in writing.

I'd love to see a collector come up with a new tactic . . . if only to break the monotony. Can't these folks come up with something better than variations of the old "If we don't have your payment by 3PM, the police will be at your door by 5PM" crap.
When I got into payday loan hell it's all I heard. I had committed "internet fraud," "check fraud" and every other kind of fraud there was. These lenders, who must be the village idiots, tried to convince me that they had conducted these thousand dollar investigations to collect $300 debts, had the police and the US attorney in their pockets and only needed to make one phone call to destroy me and my family.

But in the end, all they could do was call over and over and act like the little bitches they were. No one ever came to the door, no lawsuits ever got filed and nothing ever showed up on my credit report. In the end, I paid off the ones that acted decently when I got my tax return, told the others to go to hell and never looked back. That was two years ago.

Here's an idea guest, why don't you CA's start following the laws and maybe you will not get sued.

Amen to that, LawStudent and ramj70. These places would not have to be so paranoid and waste their time on forums such as these if they would just do their job and follow the laws while they were doing it instead of using illegal threats and tactics to squeeze money out of people by intimidation.

Neither do I! I actually worry about it on a day-to-day basis. Prelegal really scares me even though it probably is nothing more than a threat. A couple months ago we got a call from a CA that left a message saying they needed us or our lawyer to contact them. You better believe it got me on the phone real quick. And all it was was a CA calling about some medical bills.

What they are counting on is people not knowing their rights and being so scared that they will do anything to make it all go away--even pay what they do not owe. And to the person who said just pay their bills, I say, great--but I will not pay a penny of what is not mine. Anything more than that is extortion.
