Collection Agency and Harassment

I just received a call from a collection agency that just really ruffled my feathers (that is the most forum friendly saying I could think of).

I was just approved for a small business loan through my bank..as in approved yesterday. Most of my debt comes in the form of debt for the my business but is under my personal name.
I am using my loan to pay off all of the debt that is associated with the business.

When I let the collection agency know that I had a loan in process and that I was told the funds would be available in 7 to 10 days, the guy on the phone started asking me for the bank phone number and my representative's name. They wanted to call and verify that the funds were going to be made available.

I told the guy that I did not want to disclose that information and he started calling me a liar and stating that I did not have a loan in process because he has never heard of a loan taking 7 to 10 days for funding..at which I got very irrate with the guy.

He kept on and kept on calling me a liar and talking about me as if I were a dog.

In the end, I agreed to contact my local branch ona 3 way phone call with him listening in so that he could hear the bank tell me that I had been approved and that the funds would be available within the next week or so.

Does this not fall under the fair credit act's harassment policy? Is this not a form of harassment?


He had me in such an up roar, I couldn't even think straight.

I did not even catch the name of the company - that's how pissed off I was. I am normally a rational person, but he had me so mad I wanted to reach through the phone and strangle him.

I have the original person's name and phone number, but that is about the extent of it.

Luckily, when we called the bank, nobody answered.

If/when he calls back, I am going to make him aware that I am recording the phone call (even though it really won't be) and then I will ask himn to send me information about my account in the mail.

I will request that he send me a collection notice with my account number, an address that the funds can be sent to and a phone number I can contact them back at. I will also state that I want them to cease and desist the harassment.

If he persists, I will simply hang up on him.

Well, they contacted me again today. I told them that under the Fair Debt Collection Practices Act of 1978 - I see their form of contact as harassment and I wanted the calls stopped.
I also stated that I felt that the conversation I encountered on Friday to be a violation of the above act, in regards to harassment, and that if I had another conversation like that I would be reporting it to the Federal Trade Commission and my states Attornet General.

I requested that a letter be sent to me stating the amount I owe, an address that the funds can be sent to and a phone number that I can call to let them know when the funds will be in their hands.

I told him that I refuse to divulge any additional information about my loan and that when I have the funds available, I will make the account good.

In the end, they have agreed to stop contacting me UNLESS any further legal action is to take place or there is a change in my account status.

Further more, once the funds have been received from them, I demanded a written apology, from the offending party, for pissing me off so badly.

I am sorry, but not believing me and forming your own opinion is one thing...but openly calling me a liar is another.

He does not know me or my situation, therefor, he has no legal right to accuse me of being untruthful.

Ok, I am stepping off of my high horse now....
