hayt & Hayt & landau just called me at work and offered me a settlement for a providian card I had in 2003. The last time I paid was Jan. 2003 and the SOL runs out on Jan. 09 because in NJ it is 6 years. It was a 4,000 card and now they say I owe 8,000 for court fees and stuff. In 2005 they won a judgement against me and cleaned my bank account out for 1500. Now they state they are going to garnish my wages. What should I do now?????

You do the right thing and start paying your debts off when everyone wants their money at the same time and I can't afford that. I'm already paying 500 bucks a month from my check on school loans.

What's my next step?????????


If they won a judgment in 05 then the SOL and the amount owed and interest rate would be based on and set by that judgment. I don't understand why they would scarf $1500 and then wait 3 years while doing nothing though. I would think they would have filed for garnishment in 05 if they could have since they have the judgment already. I don't know what the SOL on judgments is in NJ but you cand find that info on this site somewhere.

Yeah I thought three years was a long time also. Should I send a DV letter? Do you think they are full of crap and trying to scare me? I dont even live in that county anymore. Does that make a difference? I'm tired of this stuff. Maybe it's time to get a lawyer?

A DV letter and a lawyer won't do any good I don't think although you should be able to get a statment showing exactly what you paid and what you owe. A DV letter might help get that statement.

They have a judgment already and you owe them according to that judgment. With a 20 year SOL on that judgment they could afford to take their time. I would just save up some cash and offer it as settled in full.

It's a matter of public record. Anyone can go down to the courthouse and get the required documentation. Even me. I'm not following your train of thought here. They were awarded jusdgement, they have already levied your bank account once and for some reason left you alone(I imagine so it could draw a nice juicy chunk of interest), are now coming after you again, have a LEGAL right to do so, and you still aren't getting the ramifications of a bad decision? What piece of the puzzle is missing?

Hayt keeps calling me at my job stating that they are going to garnish my wages. I told them the second time to send it in writing and validate the debt. They state that they sent it out on July 16 but I never received anything. I sent them a certified DV letter on Saturday July 19 anyway. Does this sound legit on their part? Why didn't they send it from the start?
