I was served a summons from a JDB last month. I followed the rules and filed my answer with the civil court denying all in the complaint. Some for not enough information, and some for feeling that this agency didn't/hasn't proven that they have the authority to sue me. It was accepted according to the court site. I followed my case on-line and it showed that I was assigned to a judge and I have been waiting for the next step which seems for all the other cases to be "pre-trial" hearing. Yesterday it was posted on mine that I have a mediation scheduled for May. I am sort of thrown. I have been waiting for Plaintiff to file discovery, answer request and such and also waiting for my opportunity to be able to make them prove to me and the court that they have any signed contract by sending them my request for answers, interrog. and such. Can I still send them a request for interrog., answers?? Or am I screwed? I have 31 days before the mediation. I feel like I am going to walk into this mediation without any ammunition other than my word saying "I don't feel you have the right to sue me". I know the mediation is to try to get us to settle without going to trial so I feel pressured that I am going to have to admit something I don't agree with and end up paying them. It's an attorney rep. Midland Financial. Can you help me with suggestions. 1. should I go ahead and file my questions with the Plaintiff's attorney and the court 2. Just show up on scheduled date and refuse to settle (but will the judge hold this against me) 3. hide under a rock :-) Any help would be appreciated.
