Hiday and Ricke collection practices

I have a lawyer - received papers from Hiday - asked attorney if we needed to call, try and settle the debt that a client of Hiday bought - they were not the original creditors. Our lawyer never responded to Hiday in '08. Hiday took our car that was free and clear. They would not settle for any amount and are making a fortune in interest and penalties. Original amount of debt is 1/4 of what Hiday has on their books. Something very wrong with the collection practices in this country. Oh and by the way this companies are protected by the government under collection laws passed by our Senate. There is also something wrong when they can take your only means of transportation to work etc.


This CA is located in Jacksonville, FL too. This is probably the first I have heard of any experience (good or bad) that anyone has had with them.

I would never be one accused of defending a CA; however, I think we need a little more of your story antiHiday&Ricke, it just seems to me we're not getting all of it.

I did check out there website and noticed a little tidbit I thought was interesting, though. Quote - "Please do NOT call our clients directly. This will only cause confusion. Now that the matter has been turned over to our office, it is essential that you deal only with our firm." If they aren't following the FDCPA, you do have the right to contact the original creditor, though. Don't you? That's the first time I've ever seen anything "disclaimer" like that on a CA's website.

Anyone have any thoughts on that?

There is no more to say. We hired a lawyer. Chase sold the loan to Hiday and Ricke. Layer got the same papers we did. I faxed him the papers with a cover letter asking what we should do next. He was going to handle it. He told me they would not talk to us since we had a lawyer. We received no advice in fact our lawyer was very surprised that the car was taken.

I live in Florida and unless there is alot of money to be made no lawyer wants to sue another member.

Then you should definitely think about filing a complaint with the Florida Bar regarding the attorney that screwed up.

What I don't understand is how Hiday and Ricke managed to get their hooks into your car. Was this a car loan? I know you stated you had the car free and clear; however, I'm still not understanding this. I would have thought the worse H&R could do would be to garnish your wages.

Have you looked into getting in touch with another consumer attorney concerning this case? If you ignored the summons thinking your attorney was handling it and H&R got a default judgment based on this, then it seem there is something that can be done about this. I'm definitely not up on laws and legal proceedings, I had help from a legal aide attorney when I was sued and she handled it quite nicely for me.

Maybe someone more knowledgeable than me could offer some insight?
