I recently found by mistake (I got a memo which was not supposed to deliver to me at this point) that I will be sued by an collection agency who has never contacted me in the past. And I do not know what account it regards to.

Now they filed the case against me in Los Angeles, CA where I used to live until a year ago. I am now in NY. I am thinking of hiring a lawyer.
what would you suggest hiring one in CA or NY?

Any suggestion (pros and cons) would be appreciated.

Welcome Confused!

I had a similar incident happen to me just two months ago. I was being sued in NJ and live in PA.

When I hired an attorney I had other issues and he was a FDPCA attorney here in PA. I would consult an attorney in NY who handles consumer debt and see where they recommend.

Also, it is very important that you try to get a copy of the summons if one was sent. Do you have any idea who may be suing you?

Can you give us more information and we'll be able to send you in the right direction.

How did you find out that you're being sued?

I have not yet received anything.
well, I have no idea what is regarding as mentioned earlier.
A memo was dropped in my mail box, which was to verify my current address by postmaster and send back to the investigator in order to process legal matter. But, it was delivered. In it, the court which the case has been or will be heard is LA County Superior Court. Resurgence Financial LLC vs "ME".
Again, I have no idea what it refers to. I had never heard of this company before, and this company never listed in my credit report. And drop the bomb,
am I being taken straigt to the court?

Find an attorney if you can. LA County Court has no jurisdiction over you. Not to mention, seeing that you are not a resident of California, they would have to have the judgment (expensively) moved to New York.

If the case has not yet been heard, answer the summons stating your first defence as that you are not a resident, nor do regular business in LA County, so the court is lacking in jurisdiction.

I found yesterday the case has been filed going through the record. I used to be California resident and now New York. As of May 2, the complain was filed, summons was issued and filed. Nothing further info is available...either I am served or have judgement. I would like to take it outside of the court because I still do not know who is the original creditor or if it is really mine. Sent a validation letter this week to this collection agency.
I found the lawyer in California as well, who told me not to contact the collection agency at this moment.
I really want to know what this debt is all about, if it is mine, I will take care of it.
