They called me looking for Mother today
I answered my phone today and a woman asked for me. I asked "Who may I ask is calling" she was very rude and spouted off her name and company and said she needed me, I told her that it was me and she said I was listed as a reference for my mother and that I needed to take her number down and have her call. I was also told by her that they were NOT a collection agency and she had a File that was just opened up against my mother. They talked to my mother also, and told her she could not send a money order by mail, they would return it, that she could pay by phone IF she sent a copy of her D/L and the Debit card by fax AND that ontop of the additinal $20 they were already charging for handling the account they wanted ANOTHER $12.50 to process the card. OR she could do a money gram which is $10.00. I called them back and asked for a supervisor, he was rude from the moment he came on the phone and I got nowhere. DO NOT PAY THEM! Do NOT belive ANY of their scare tactics, what they are doing is Illegal. Call the company you have the debt out with, you probably will need to be persistant and get to Corporate and get someone a bit high up, Let them know you want to pay your debt or make arrangements and tell them your expeirence. MOST companies will take your payment directly. You made the debt with the company NOT the CA, and you CAN pay the company directly, you just have to know how to go about it and don't take no for an answer. I have received several calls from H&P, all threatening to arrest me at work or my home. I was worried at first, but, after the 1st or 2nd threat and nothing happened, I knew they were just blowing smoke. I haven't started the process yet, but I do intend to file a complaint with the AG in the state of Florida.

I just received a call from a John Lewis and he told me that I was going to be arrested and so on for not paying a debt. Can they show up at my work and if so what can they do or has anyone shown up at any of your works or home before? What should I do to resolve this matter? I asked to set up payment arrangements and they said that I could not do that so i am not sure what to do..

for starters,john lewis broke the law stating that.debts are civil matters,not criminal ones.you can't and won't be arrested for owing a debt.next time this bottomfeeder calls confirm your address only.then tell him to send you something in writing.hang up,do not talk to him again until he sends something.that is what you do.
Spoke with Owners
I spoke with one of the owner's wives today and she is HIGHLY concerned. They just purchased this company which YES was previously Legal Mediation. She said that they had an idea that the previous company was doing some shady things, but they did retain alot of the former employees, and have been gradually weeding them out. Hopefully this company can make a turn around and get rid of the past people that are being rude and doing things illegally

The person suppsedly managing the agents there is a Mr.Stuart! This man is rude, its funny you call them with an attitude and they tell you to speak to them with respect. I told Mr. Stuart, alright you want me to speak to you with respect then how about you pull everyone off the phone for 20mins and train them on the way to RESPECT people, he told me that I do not sign his paycheck so I needed to stop telling him how to do his job. After that call is when I did a smartpages.com search on Mr. Henrion, who was listed as one of the Presidents, got the residential number and spoke with his wife. WELL now it seems something is happening because this Mr.Stuart contacted Checksmart and started yelling at them telling them they interfeared with his collections by accepting my Mother's payment directly...even though they are who the money was owed. Then Mr. Sturart LIED to them and said that my mother had turned Checksmart into the proper authorities and that they are in trouble, when it is H & P that was turned in.

I received a call from a Amy Bishop at work today. She said that she was from H & P capitol and that her company was hired by payday loan services. I asked her if I could give her my cell number to call me back later as I could not talk at work. she stated NO you call me back and do so before 3pm becuase that was when they were refering this to LEGAl and I would have my pay garnished and she did not want me to be embarrassed at work. I went to lunch and called from my car and asked how can they do this without going to court and obtaining a judgement against me? I also informed her that I have been in contact with someone at payday loans and have made arrangements. She stated that 2 other collection agencies before it was sent to H & P. I asked her what agency's and she said the only one that she could remember was AIS ( I have never heard from them) which is what I stated to her. She put me on hold to get a floor manager to help me... A man by the name of Tim H got on the phone and I stated the same information. he stated that this was more serious than a wage garnishment and that if I was " a few dollars short" he could work with me. He stated that because the loan was " such a large amount" that I had to pay it today. When asked how much he stated $795.00. I told him I did not have it and he stated ok then I hope everything works out for you . Good Luck and at 3pm this would go out. Guest, seriously, you don't need to stress over their empty threats. Be sure to educate yourself on the fdcpa as well as your state laws regulating CA's, so you'll be armed when you call them back.
I would recommend recording every call, if you are able, you have with these jokers so you can sue them for violating the FDCPA. Be sure to file complaints with your state's Attorney General, the Florida Attorney General, and the FTC.
I guess they must still be having problems "weeding out" the employees that are still breaking the law at H & P Capital.

I just found out that H&P Capital is not licesed in Massachusetts at all and Payday loan services should not have provided a loan to a mass resident. Per their website Paydayservices.com it says loans are not available in mass but they gave one to me anyway. What do you think that I should do at this time

I received a call from these people today. I first spoke with Eric Lloyd (x276) and then Tracy White (who is supposed to be a supervisor x278). They were both very calm and nice. My call was similar to many others--i needed to make a payment before 3pm or else i would be served with papers at home and/or at work. I was told by both Tracy and Eric that to make a payment by credit card i would have to 1. send the money by moneygram, 2. send the money via western union, or 3. submit the payment to them by credit card. Tracy stated that i could make the moneygram or western union payments online and it would be cheaper than using the credit card because there was a $30 fee involved with using the credit card.
when i went to send the money with her online via moneygram, the receive code she gave me (6768) could not be found. when i went to send her the money western union, the city code she gave me (HPJax, FL) also could not be found.
When i called her back and told her i could not send the money, she told me that the people at western union and moneygram did not know what they were talking about. She then advised me that if i wanted to submit the payment with a credit card she would need a copy of the front of the card, a copy of my drivers license, and a statement saying the following:
I, ___, give consent to H&P Capital to run my card in the amount of $____ for file #_____ on 1/30/09.
Signature________
She said i should do this for each person that i would be borrowing money from until it was paid in full. Once i had all of those documents, i was to fax it to: 904-672-7225.
This is when i got skeptical and did not call back. I live in NY. Is there a chance that the police will come to my house?

H&P Capital harassing phone call
I just got a call from a Spencer Gray regarding a valid debt that I do have. I was also advised that I only had until 5pm to pay or I would go to jail or be embarassed on my job. I attempted to make payment arrangement with Spencer Gray and he refused to do so, this would explain the hard sell tactics that they are using to make their commission. I have made payment arrangement with another collector with regard to a debt, so why wouldnt they be able to do so as well. This is illegal practice and I will be reporting them to the BBB as a result. I called back and also asked if they were previously the Legal Mediation Service and he just stuttered and said he did not know what I was talking about. fine the debt is owed,but that doesn't mean it's owed to them.send DV and C&D letters to this bottomfeeder.send them certified mail return receipt.do not pay anyhting to any collector not just this one without something in writing.they cannot threaten arrest.that is my first sign of a scam or bottomfeeder.

Absolutely, if a CA calls and starts off with the high pressure and threats of arrest and embarrassment at work, you should be very weary of giving them a dime. If they flat out refuse to validate the debt, in writing, then you should not give them a dime. If they promise you a PIF letter or DV letter only after you make a payment, you MOST DEFINITELY SHOULD NOT give them a dime; you will never see these letters and you will be out your money.
Any reputable CA should have no problems with providing written verification of a debt or working out some sort of reasonable payment arrangement with you. They always demand the entire payment up front; however, don't seem to realize if you had the entire amount to pay, the two of you wouldn't be having the conversation in the first place.

Coming on here and posting about your horrible experience with this company, along with reading other's posts about the illegal shenanigans might make you feel better; however, nothing is going to get done about these bozos until enough complaints get filed and someone takes notice.
I've done all the hell-raising I can with the Florida AG's office and Secretary of State about this company, so I've hit a wall. It's up to you guys to file those complaints!!!

But I got a call today from this company today. Went to VM. The lady was very short with me, saying it was urgent to return the call, and ended with the "good luck" line. Ok, Edward R. Murrow...thanks for that.
Anyway, I live in South Carolina. What can they do to me? Is this company licensed to make these kind of requests/demands to a SC resident?

I told him, that sounds very suspicious to call me after the deadline. At first he also made it seem as if he was calling from a court. I asked him a few questions and said I need to speak to my attorney before I do anything or believe anything they say. He tried to convince me not to speak to an attorney, saying that I wouldn't have enough time because of the deadline. I then asked him to send me documentation regarding all of these accusations he was making against me and he refused. I spoke to a Mr. Stephens and after I started grilling him with questions, he hung up on me. I called back and asked to speak to his supervisor and he put me on with someone named Richard who said he was the director of the whole company. He ended up hanging up on me too, and I'm sure he was not the director. I am thinking of filing a class action lawsuit against them. No they cannot. It is against the law. Hire a lawyer, if you need to go to Legal Aide. Tell them the situation. If you are working with PDL they are suppose to give you forms to take with you to court. This is just a scare tactic. They actually work for the Pay Day Loan People. What they are doing is illegal. Report them to the FTC- Federal Trade Commission.
If they persist and cost you your job, you can sew them.

It's not a matter of not having the money. As I said, I gladly set up plans with another CA for a PDL issue. But these folks appear to be unwilling to work with customers on anything.
I refuse to be called at work and be made to feel like a criminal.

I asked for his title, his boss, etc. and he laughed at me and told me to try again. I asked how I would go about paying this money if I could get it today. He told me to get the money and call him back. What is this all about? Is this a legitimate company? Who are they? He would not give me any information (i.e., who I owe, how much I owe, etc.) regarding these monies. HELP!!!! I lost my job (after 11 years) last month and am trying to make ends meet. When I told him this, he asked me if I was going to blame the government for me not having a job?

I have checked, and they are currently licensed as a CA in Florida. It went into effect 12/5/2008 and expires 12/31/2009. Again, this is only for them to operate as a CA in Florida.
You should check with your own state agency to verify if they are licensed or not in your particular state. If not, then they are violating the law and you need to report them in your state.
If, however, they are violating the FDCPA, you need to report them to your state's Attorney General's office, the Florida Attorney General's office, and the Federal Trade Commission.
And it's PAINFULLY obvious, they are still violating the FDCPA. They must still be trying to "weed out" those bad employees we heard about in an earlier post.

I received a call today from a Ms. Gatlin. She was very rude and said I owed $614.00 and their office would need it today in two hours. I said I never heard of such a thing. She had also left me a message to call and at the end she said Good Luck. What is that all about. Then she fast talked me and stated she could tell in my voice I was not cooperating and would suggest to her client I did not want to pay. She then transferred me to a Mr. Johnson who also fasted talked me and tried also to intimidate me and stated I needed to borrow the money from friends and family. I said I would take care of it tomorrow but did not know what else to say. But all the while asking who are you and what does this company do. No one ever answered that. Just stated this account was in a legal status and needed the money today. I tried calling the AG office of Illinois to see who these were. I did call back and this Marcus person was rude because I asked if they formerly another company. He was very rude and spelled out his name when I asked again. Then I received a phone call from a Tim Hoffman wanting to know what was I asking questions for. And I said I was just curious. So I don't think I will be sending any money to this organization. I was with this PDL company but they took all my money as well. So can some one tell me the address of this H and P Capital? I need to write to them to stop calling my job.

I'm glad I looked this people up on the internet. They keep harrassing my relatives and they keep telling them that I've got to call. The website was trying to rip me off anyway with a bunch of B.S. in regards to constant renewing of the loan without stopping it and trying to keep it rolling over & over! So, their trying to make me pay a lot of extra interest when they've taken more than double from me than the loan was worth. After that, you have 30 days to dispute the debt they are collecting on. Send them a debt validation letter certified mail return receipt requested after you get their letter.
They are perfectly in the law calling your sister to look for you, as long as they do not mention they are collecting a debt and that you owe a debt. They also cannot say they are a debt collector.

A friend of mine was contacted by this company trying to reach me .I immediatly contacted them back and recorded the entire conversation lets just say not one thing they said was legal they violated every fdcpa law you can imagine ,To make a long story short they threatened to arrest me at work or home refused to provide any type of validation and desperatly tried to use scare tactics . well low and behold i work for an attorney, and i plan on pursuing these scumbags to every extent of the law. they are all fluff and no fill. In theory, you should get a letter within 5 days of the initial telephone contact; however, I'm willing to be you never will. What I would do, is go ahead and send them a debt validation/partial cease and desist request. You can find the address in this same thread, just hunt back a few pages. I would also put in that DV/C&D letter that H & P Capital is not to contact you at work, or contact any third parties regarding you or this alleged debt without your written permission.
File complaints with your state's Attorney General's office, the Florida Attorney General's office, and the Federal Trade Commission.
Above all, do not fall for their threats or intimidation tactics! You cannot be arrested for owing a debt and not paying it back, for whatever reason.
