Have you been served with a summons or are they just threatening you. If it's just a threat, then it's probably an attempt to intimidate you to pay.

They have summons me and i tried to come up with a payment plan with them but they didnt want to deal with that because the payment i offered was too low for them so they didnt want to work with me. now this month on the 18 they want to file a judgment and garnish my wages, which is bad because i work at a financial institution. i had to hire a lawyer to prevent them from doing all of this to me.

It happened to my husband last year, we were in the process of buying our first home and out of the blue a lady from a legal law firm (i checked them out) called and threatened to garnish my hubbys wages. We paid the 800.00 and recieved a paid in full letter about a week later.

One important thing to remember, though, this "legal firm" would have first had to sue your husband and win before they could get to the point of garnishing his wages. It's not like they can just wave their magic "legal firm" wand and it happens over night.
True, if it was in fact your husband's debt, it was probably easier to take care of the issue as you guys did; however, these people count on a consumer just being afraid to hear the words "garnish your wages" and that the consumer will pay whatever to make the caller happy. Sometimes the consumer may not even owe the bill or, even worse, cannot be sued because the debt is outside the statute of limitations.
Always educate yourself before you ever deal with a collection agency.

I am being garnished by HSBC!!! I just got my check today & found that I am being garnished. WTH!!! I had a conversation with one of their attorneys where they tried to put a lien on my parents house that I don't even live in. They are garnishing 25% leaving me & my family a little of nothing. He was supposed to call me back after a few months when I last talked to him to make some arrangements. I heard nothing from him. Net thinking I know. Bam!!! I am being garnished. These are hateful people.

Guest were you notified that you were being sued? Check with the county clerk to see if and when you were served notice. If you weren't served notice properly, you can have the judgement vacated and the garnishment stopped.

guest, you probably are not being garnished it might be a wage assignment? in which case i am pretty sure you can revoke it (i did that for a payday loan, i just talked to payroll)
for apj, i am kind of dealing with HSBC now. they gave me a huge run around and keep giving me to collectors. I am currently waiting for a collector to validate before i work out anything. is it a collector telling you this or is it HSBC?

Check with your HR dept. It could have been voluntary. If not, then you need to go to the court and ask them if the lien paid the judgement. It may not have, as your house was likely short sold and the mortgage company took it all. If that was the case, then there isn't much you can do about the garnishment. Judgements stay active for many, many years (as long as 20 in some states, and other states they can renew it every 10 years making it effectively permanent until paid).

doesn't seem like HSBC wants to work with me....have 5000 bill...had to drop my min. paynmetns to $75 due to fuloughs & paycuts....I've sent them 4 written notifications of my situation...can't call them from work & have no phone access (at home..temporarily)...is there a savvy attorney out there that can do a nationwide class action suit against these people? I don't want to NOT pay....I only want to pay what I can afford at this time. Once things get better I can get back on track. I, like most people, do NOT want to be in this situation in the first place!

The only way you can get this burden off you is pay it. These people made my life a living hell, but they offered me a settlement which was way less than what I owed . Luckily I was able to pay them off, it's heaven not to hear these snakes on the phone 10 times a day laughing and making their devilish noises, intimidating me, but folks this is what they do. My advice never go in debt with these shady assholes and you won't have to put up with them. In the end they can call you if you owe the bastards, so never take out a credit card with them. in just received a phone call stating that i will be sued if i dont pay up my debt of 2600 and some...are they really gonna sue me over this little amount.. my card was a 300 dollar limit and now i do not understand why they let the interest got so high i though the interest would have stop one i made a payment which i did a while back but u know situations happen and now i couldnt afford to pay but now my interest went back on and now im being sued for over 2600 are they really gonna do it or not.. what is the first thing that i should do... i tried settling a payment with them and the lowest they can go is to take 600 out of my account now and then monthly poayments of 153.. i can afford the monthly payment of 153 but i cant afford the 600 out of my account now... can anyone help me

Yes, just went through wage execution. Made the grave mistake of taking a home equity loan first (another story) with then HSBC Beneficial which extended the offer for a credit card limit 1,000. Due to divorce, fell behind on payments with the card and equity loan. Just finished wage execution, but the kicker was prior to the wage execution, how about a warrant was issued for my arrest in the midst of attempting to resolve the matter via payment arrangements because I failed to disclose my financial information. The debt has since been paid (thank goodness) and I don't have to deal with that aspect (i.e. HSBC Orchard Bank credit card debt), but am still a fugitive of the law. How about the law firm it was sold to still insists that I provide my financial information after the debt has been paid? Only when h_ll freezes over. Living in Newark, NJ you would think the courts have real criminals to worry about. Go figure. Therefore, unless you enter into a payment arrangement or you need to go to the court to plead your case. You should have received a court notice and date for an opportunity to explain your circumstances to a judge (and have a darn good argument regarding why not) the wage garnishment is as good as done.
Of if you are willing to enter into a settlement for less than the amount owed, but get it in writing....and do be sure to review the fine print to ensure that HSBC will not come back in the future to collect the balance. Since its 5k you may want to have a lawyer represent you in the discussions....otherwise, they will lie quicker than a cat can lick itself.

I would highly suggest you clear the contempt of court charge. That charge is seperate from the debt...the warrant was issued because you refused to answer the court. It wont go away...and is likely to bite you in the ass sooner than later.
