I requested Validation back in Aug 2008 they never replied
instead they are calling around trying to embarrasses me with family...
As they know where I am and they also have my # however they have not called me since Aug when they got my request for Validation.
How they found my son baffles even me as he is 36 married and is not on any of my accounts in fact to tie us in took some
fancy work on their part which is scary to think they did that.
There was no legit reason to call him except to harrass me .. I have filed a complaint with the BB of New York they do have a rap sheet of complaints..But that probably wont stop them so please any advice would be helpful ..
Thanks

IMHO, the BBB is a useless place to file a complaint. No effective discipline will come out of it. You need to file a complaint with your states AG office where they have some legal clout....and you might wanna consult a NACA attorney and file suit yourself against them for fdcpa violations.
Update on Hudson
Thank :) s for the information I have since reading this earlier filed.....
complaints with the Texas Attorney General ... FTC ....
E-mailed Bud Hibb ... Will contact lawyer I have one from last year about another issue so far he has not been needed for that issue ..
Thanks again for for the helpful information .. I will not ever file a complaint with the BB again ..

I noticed your mention of the Texas AG..does that mean you live in Texas? If so, you have some good consumer laws, such as any DV request MUST be answered within 30 days.

Yes I live in Texas .. Well they did not respond at all sounds like I have a good case against them ..

Personally I would go for the damages for the embarrassment they caused. When we went for settlements , we got way more for "pain and suffering" for the embarrassment than from the FDCPA violation.
Yes they caused a lot of embarrasment thanks for the good advice
Yes they caused a lot of embarrasment thanks for the good advice .. I am now wondering how many other people they have called my friends that are too polite to mention it ..So it has caused that extra strain not knowing who all they have called they really have added the the stress mix...
And from get go I have written letter after letter trying to get the CC to work with me they do not answer with a workable solution they just keep adding late charges and calling
I sent all the letter cert so I do have proof I tried to work out
a agreeable solution but it is better for the OC to just sell the debt and then you get "goon collection agencies"

CB/HV did nothing wrong contacting your son to find you. as long as they did not disclose any information to him no laws where broken. and they do record every call in and out out of that office. Stop, and do not go any further you will lose. I know from experience with them.

First off...put down the crack pipe. They absolutley violated by contacting his son. They have current contact information for him so the only reason to contact a third party is to harrass or embarrass the consumer = VIOLATION. Run along little troll..go score some more dope and live in your little fantasy world.

Don't forget the fact they are required (in TX) to respond to validation within 30 days, and didn't.
Plus, gotcha, you revived a thread that was a half month old.
