Isn't this an Illegal Judgement LRLO???

On April 18, 2013 I received a letter from an agency called uGotFICO, Inc. telling me I had a judgment against me OCSuperior Court and the case #. This company helps you with debt collectors. I told her I never received a summons or was served. She told me the dates the court has on record. She helped me navigate through the Court web site to look at the judgment. Judgment was in October 23, 2012, and proof of service July 3, 2012.
I down loaded the Judgment and the proof of service. Because I never received a summons or was served. According to the papers they turned in for proof of service not only was the incorrect house number but I haven't lived there since March of 2010.
They also had my current address, because I had received letters from them. My current address had to be in the paperwork somewhere for this other company to send me a letter. I also registered a change of address with USPS when I moved.
This is UNLAWFUL ISN'T IT? what do i do now?


You can motion the court to have the judgment set aside due to improper/lack of service. It is quite likely though they will turn around and serve you at your new address.

USPS change of address is irrelevant.

Just go through the rules of civil procedure at your county court website. You may even have a discussion with the court clerk. You may get some help in paperwork.

I think it'd be best if you got some legal assistance regarding this.


Oh please.....this is not rocket science. If you dont know the answer or cannot offer constructive advise on how to handle this, dont waste your time posting. Why should someone pay at minimum $500 at an attorney to fill out paperwork??
