If he has sold your account to them, then you can request him to take back the account from the collection agency. First, let's clear up some bad info. If the original creditor sold the debt, then they WILL NOT take it back from the debt collector. I have no clue why anyone would think that, let alone advise someone of that, but once the OC sells it they have washed their hands of it and they are out of the picture.
OK, now, it doesnt matter if the account was charged off or not--you still legally owe it. OC's charge off debts every day and then sell them to debt collectors, it is perfectly legal for them to do so.
Yes, they can take you to court, but it depends on the size of the debt, and many other factors--the first of which is whether or not they own the debt. They may not own it, they may be collecting on behalf of the new owner, or they may be the ones that bought it. you need to check with them to be sure
Regent is a scam!
I can't believe no one bothered to google Regent..AKA Imperial Recovery. They are scam artists being investigated in more than one state than for their business practices. I was contacted, or I should say, harrassed by them for months. They kept telling me I owed a debt to a bank that my mother happened to be VP for in the past. Because there was someone in the legal department my mom was still close to, I emailed her. She immediately emailed me back advising to not even speak to them. They were in no way affiliated with or doing business with the bank in question and I did NOT owe what they said I did. I was an old debt I had already taken care of in 2007. They currently have about 260 complaints against them with the BBB. Do not deal with this company! Once I called them and told them what I had found out, the calls stopped completely.
