I work for a credit card company doing collections. Some collectors are not educated that your spouse/partner or ex of both is stil not supposed to get any information about your debt. There may be one way to get it though any statements laying around could tip the partner/ex off and give enough info to a collector to gain access to minor info(not past due or status of account) not all collector do their jobs legally or attempt to do so...money is out there above the fines right now if a bad collector can get the money then they will. I wish you well and I'm a ethical collector (or what I best believe to be ethical and I know what its like to have colector after you)

Well that's a tricky one. I can't consider it the CAs fault since the ex is misrepresenting himself. According to the FDCPA, a spouse is not considered 3rd party [15 USC 1692c(d)].
I have searched for quite awhile now but haven't been able to find a criminal statute that I can reference, so I suggest you go to the police station and inquire into the misrepresentation of the ex. I am certain that you can press charges. His action was inexcusable and he should be held accountable in a court of law.

It used to happen when I was in collections all the time...people lied that they were the spouse because they were concerned or just plain nosey. No liablity on the CA side. A credit app it a picture of your maritial status on that day. Plus the CA's dont get the application and non of the systems I worked on even had a field that status.
