Anyone ever taken CA to court themselves & won?

How would you act on your own as a consumer to initiate a suit against a CA, without a lawyer, when they violate FDPCA.

Is it possible to do this without a lawyer & win a settlement? Just curious.....I've actually won a few cases, but only with a lawyers help - so they actually got more $ out of it than I did.


Yup, it never made it to court..they wanted to settle, so basically I won. You just have to know your rules of civil procedure. Plus, admittedly, Texas has some very distinct collection laws and they are pretty straight forward, no way for a CA to wriggle out. But you can easily sue in small claims yourself.

CajunBullDog, save your $.08 a page, No Nonsense probably couldn't even read or comprehend what you sent him and he would likely try and skip out on paying that bill. Then you would have to get a CA to go after him for it.

No Nonsense Collector, your screen name should actually be "Know-Nothing Half-Witted Dullard." As I imagine your IQ is probably not much higher than that of a Chimpanzee, and I feel like I'm insulting the Chimp in question when I say that.

For your information I sued a CA also. They settled out of court as they knew I would be able to get a hell of a lot more, plus they would be made to look like the extortionist criminals that they are, if it did go to trial. I did have an attorney representing me; however, I'm sure I could very well have done it without one, as the fdcpa violations were extremely well documented.

And no, they didn't counter-sue for what I owed plus additional fees. And, believe it or not, I eventually didn't have to pay what they claimed I owed, from my own pocket, on the debt in question. What I settled for with the CA more than took care of that for me.

I'm actually getting ramped up to sue another CA for completely ignoring a debt validation/partial cease and desist letter.

So the CA's that do violate the FDCPA need to watch out, they'll be the ones eventually owing the debts they are breaking the law and harassing the people they are trying to collect from.

Let me elaborate. I've won 3 cases against pompous idiots like you - the last one resulted in me getting $2,500 due to a serious violation.

I settled for a monetary award that I can't now name (but I named it before I signed the papers if you go look at my LVNV thread). Plus the permanent stop on all collections and removal from all the CRAs.

NNC is a broken record and not even worth any more responses, I swear he/she/it never even reads any responses, just posts willy nilly.

I have a friend who wages were being garnished in this state(SC) and this is a non-garnishment state there were taking out $50 a week for 4 months.She got her money back and plus $1000!!!The best part was the Judge caught the CA lawyer in a big lie which landed him 30 days in the county jail!!!!!

Well I guess my nose should be about 10 feet long by now NNC. But it is not, because I am telling the truth!

I did win my lawsuit with a CA over their violations of the fdcpa. Granted, they settled out of court, but it was still a victory nonetheless.

I might recommend, rather than wasting your time posting your inaccurate and mindless garbage on this website, you sit down with your bowl of beans and rice (noticed that thread got locked pretty darn quick like) and do a little research into some of the crap you post. Google is a pretty user friendly search engine, I think even you could figure it out. You would find you're dead wrong on all of it.

Who knows, might make you a little better person. It certainly would make you a lot less of a moron.

Of course, I'm wasting my time posting this response, as the pea-brain will never read it.

Hey.....wow.....NNC actually came BACK to a thread and responded! Good for you! Do I see a scratch forming on that broken record???

And watch this...I'm getting ready to sue Arrow now! Likely these guys will break and pay me, with their tails tucked firmly between their legs! Keep an eye out for my Arrow post :)

NNC I seriously hope you are not actually one of these companies...if so, you might as well just pay me now and save me the trouble of suing. :):):):)

Cajun! Thanks for being "johnny on the spot" like that.

It is unfortunate; however, in the past NNC posts have managed to get us to start tearing into each other, when we really should be tearing into him. So it's great that you lock those disruptive threads before they get out of hand.

I, for one, really appreciate that.

Sorry Golden, you completely missed it. The thread appears to be deleted now.

It was a pretty offensive post, even by NNC's standards. I can't remember all the specifics of it; however, he made reference to eating bowls of beans and rice in order to save money to pay your debts. That's where my comment came into play, advising NNC to sit down with his bowl of beans an rice and do some researching on the Internet.

I'm not sure you would have gotten a chuckle from that one.

Funny thing, though, my mother makes some pretty good beans and rice. And there's the ever popular Louisiana dish "Red Beans and Rice!" My favorite!!

Anyhow, just so this post isn't totally off topic...it is actually rather easy to sue a CA as long as you know your rules of civil procedure and keep good records of all the violations.

BTW, go gettem FrogPatch! I'm sure that's another open and shut case that NNC just won't believe either. Can't wait to hear how it goes for you.
