Has anyone heard of this collection agency???????????
Date: Tue, 04/29/2008 - 11:50
I have been receiving calls from them and they are not very friendly. I sent them a validation letter and haven't heard from them.
Has anyone out there heard of them or worked with them? All the credit card and medical debt we have I have received information on. I have some payday loan accounts that I had and defaulted on because I have overpaid and they were illegal. Not for sure if they collect on those or not.
Please let me know if you have heard of them. I appreciate any info you have...
Thanks,

Sorry I have not heard of them. Have you done a search in the search box to see if anyone has left any feedback on them?
Goudah had responded to someone else that had been contacted by this company, apparently they collect for pdl's. Here is their website address: 1st-irs.com

Hey Ladybug, thanks for the info. And yes, I did search up top, but didn't get nothing really at all. I couldn't even find them on the BBB. Hum, well, I did send a validation letter to them twice and haven't heard a response. I feel I have done all I can. I really don't want to call them and get on the phone with them, so hopefully they will send something in writing. I feel if they are legit; they will at least send something in writing.
thanks again.

While most debts aren't an issue, please be advised that writing a bad check in most states is considered a criminal offense. In Texas, if the check (or cumulative total of the checks) is $1500.00 or more, it's a felony.

Insider,
I haven't written any bad checks..so don't know why you would be saying what you did...

PayDay Loans typically involve postdating a personal check. If that's what happened, my post applies perfectly.
If not, please accept my apologies.
PayDay Loans=not a good idea, especially since any other form of defaulted loan/credit/whatever won't get you thrown in jail.
Writing a bad check though will, depending on the amount.

insider, you are right in a way.most pdl's are secured by a postdated check.internet pdl's however go by a ACH debit consent.that can be revoked at anytime.i think that is what purple was reffering to.
i agree with JCEMT,why not register you have alot of good insight.

Very nicely put Insider, thank you for clarifying.
As I pointed out in another thread, most payday loans I'm familiar with require you to have an ACH debit deducted from your bank account. The problem occurs when the debtor has no money in his bank account, for whatever reason, and the PDL company keeps attempting to debit the account when they were asked not to.
Even if there were an actual check involved, wouldn't it have to be proved the check writer deliberately wrote the check even though they knew the account was closed or there were no funds in the account at the time the check was actually written? Again, most CA's us the "passing bad checks" scare tactic in order to intimidate or scare the debtor. There is no actual paper check or there was no deliberate attempt to defraud on the part of the debtor.
You definitely hit the nail on the head! PayDay Loads = Not a Good Idea! I'm sure most every member of this forum would agree with you on that.
Actually did you know that it isn't even a bad check? Storefron
Actually did you know that it isn't even a bad check? Storefront PDLs want the check only to have your account information, the check is never even filled out. And, if it is filled out, the first time that the 'loan' rolls it is no longer a valid check as it was made for that loan, not the 'next' loan, since if you look at the paperwork, it clearly states that each 'rollover' is a seperate transaction. The hot check div of my state told me that. :)

Hey Goldenbast, that is excellent info. I am sure a lot of people didnt even realize that. Great to know.

Jinkies!
That is great information to know! I wonder if that holds true for all states. I think you're in Texas, right Golden? Seems, to me at least, Texas has some pretty aggressive laws that actually protect consumers. Not all states are so forward thinking. I think I've heard Florida has some pretty rabid "bad check" laws, that tend to protect the merchant more.
Sad thing is, my sister almost got busted for bad checks once, and my mother had to bail her out. She could not get a bank account anywhere after that, for a while. What's even worse, she was knowingly passing the bad checks when she knew she didn't have the money in her account. She was going through a very messy divorce, didn't have any money, and thought it would be OK to write worthless checks to buy luxuries like FOOD.
It is a shame what no money and desperation will drive someone to do.
Me personally, I haven't had a checkbook for many, many, many years now ; online bill-pay and debit/check cards are such a nice thing!

Yea, I'm not a fan of checks anymore - when I opened my new account, i didn't even want checks - they just lead to trouble! i still have problems trusting the bank and usually go a step further and send money orders or pre-paid debit rather than my own account.
Has anyone heard of this collection agency???????????
All of my pdl's are internet; and I have paid on all of them the principle and way lot more. I never wrote a check out to anyone...don't like checks..
I just came out here to see if anyone had any dealings with this agency. The guy on the phone said please contact me at my law firm. Well, it doesn't say they are a law firm...anyway, I sent two validation letters and yet have heard back from them.
that's all. thanks.
