I recieved a summons on friday march 20 from this law office on behalf of capital one. the amount listed in the summons says that owe $596 and some change. How do i "answer' the summons, i don't understand what it is that i am supposed to say? I live in ohio. this has never happened to me before. I don't know if i should try to call attorneys office and see if they will let me pay the $596 and be done with it or what. I'm really nervous about having to go to court but i don't know what to do? I i do not answer and a judgement is entered then will it be for only the balance they say that i owe or will there also be hundreds of dollars in additional charges and fees added as well? And if they garnish my wages will it be from both of my jobs every pay period? once a month?and after it is taken care of will it remain as a huge negative mark on my credit for all of eternity? I just don't know what i should do and i really dont want to have to spend hundreds of xtra dollars on an attorney for nothing. please give me some advice.


Hi Mandy,

Answer summons.

If a judgment is entered, yes they will tack on court and attorney costs.

Negative mark for 7 years.

And frankly, if you are so broke that you can't afford to pay back $600 then you should go to court and fight it. You can also try contacting the Law Firm and negotiate a settlement. Make sure you get a notice in writing before you pay off that settlement.
