I Love Errors that CA's Make...

Well, on the 12th day since initial communication, I *finally* get my so-called dunning letter, which includes this little tidbit:
"As of March 5, 2009 JD Enterprise is prepared to offer a settlement of $860.00 to satisy the above referenced account in 2 installments... blah blah blah... If this is not something that you cannot do..."
Not something I cannot do.... so a double-negative. So am I supposed to call if I CAN do something...
Well, oh wait, that's right... this is from 2001... SOL is way past, so I guess that is something I can do... by not paying this... ever...
Can't wait for my return receipt from my FOAD letter I sent them. I am guessing that they can still send me love notes like this one though? Even though they cannot make me pay?
Pretty darn smart thinking for a welfare single mother living in a trailer, huh? My mum done taught me GOOD!!!
I also love that I received this "offer" today, on the 13th, and that it was suggested to me that funds should be sent (and I do quote) OVERNIGHT DELIVERY SERVICE, MONEY GRAM or CREDIT CARD".
Nothing like telling me to get into further debt to pay off a debt that is way past collecting (and which was made thanks to my ex-husband to boot).
Know your rights... and then you can laugh at these shabby scare tactics...

No, it is not a violation....SOL only means they can not sue upo
No, it is not a violation....SOL only means they can not sue upon it..but they can try to collect it for ever. That is why you send them a total cease & desist letter....so if they even send another letter, that would then be a violation.
There are 2 states where it would be a violation. Those are MS
There are 2 states where it would be a violation. Those are MS and WI, the only 2 states the have a Statute of Repose in addition to the SOL. the SOR extinguishes the debt upon expiration of SOL as though it never existed.
