Needed advice for shady collection agency. Please help!

I received a collection letter from Jefferson Capital Systems LLC on behalf of MCM.

The original creditor to this account was FCNB (Spiegel)

In the letter they are stating that the charge off date was 02/09/2006. THIS IS A LIE. I had my credit report that states the first default late payment to card processing center ( whom bought FCNB AKA SPIEGEL) was on October of 2005.

I have since lost t the credit report when i moved last year.

Would I be able to call the OC I last payed and ask them for a statement of when my last payment to them was? I know i payed them by check over the phone but my bank does not keep checks that old, back from 2005. I want this information just
in case the collection agency tries to sue me.

I am assuming they are trying to re-age the account.

Of course they are trying to offer me a credit card if i pay the amount of 2,433.00.

When Midland Credit Management had this account they took 9 months to validate and all they really sent me was a xerox copy with my name and address and a amount. Since they didn't collect i guess they referred it or sold it to Jefferson capital Systems.

I know there has been 6-7 Collection Agency's that have owned this account trying to collect. I also know it it has gone past SOL. Here in California it is 4 years.

My question is in the validation letter i am sending to Jefferson Capital.

Do i tell them that I am aware that it has past the statue of limitations?

Do I also threaten to tell them that I will be notifying the Attorney General because they have posted it on my CR and they are in violation???


keep this in mind, because it sounds like youre confusing statutes here, they can still legally report on your credit file for 7 years from the date of first delinquency, not for the 4 years that California allows for debt collection action. They are not in the wrong for reporting it on your credit file--at least, they arent in the wrong for reporting it due to age.
