has any one delt with John P frye law office?

I have been paying this office for my cc debt but I am going through a difficult time now and can't pay this month. They are now threating with not continuing with my montly payment aggreement because I
am defulting this month and that I will be sent a bill for the full amt. Also is it too late to request a DV.. I did not know about that till today. Can I asked them for that and a DC until I get the info?

Sorry I don't understand respect when it comes to wrong advice. I've read enough on this web site to know that you are steering people wrong. Oh, and I was right to say that putting "arrested" in the headline gets you attention. your web site proved it did.

I've been in another credit forum and know that timing is everything. These people are asking for help and a lot of what I read is a joke. That and who cares if I am banned; i prefer to be banned because you can't answer my question anyway.

Truth is if you are really about helping people you'd tell them straight out what to do. Even if they are so confused and the info isn't enough, your site should prove to offer advice for EVERYONE and not who you choose.

And excuse me but at any way suggesting that calling a creditor is ok makes you a joke.

Hey, you're entitled to your (wrong) opinion. And if you've got help to offer, then step right up. On hiding from creditors, how long do you recommend that people do that? Until the garnishment starts? Just until the summons arrives? Sorry, I'm not gonna give somebody advice that I know for a fact is just going to make a bad situation worse. A lot of the advice we dispense around here is from solid, first-hand, personal experience. That's how we know it works.

My apologies for having gotten sidetracked there.

You can request validation at any time. They may not honor it, since you've been paying them right along, but you can request. Did they validate this debt previously, before you entered a payment arrangement with them?

No I don't recall a validation. But I will send in a certified letter for that information. Do you know how long it takes if they do look for a lawyer in my state and take me to court? I plan to continue to pay and hopefully by the beginning of next year settle the acct.

Well it is your right to know where your account stands. Check your credit reports and see how it is displayed. If it is on there, is it being reported correctly? (IE- does it reflect the fact you have been paying it, etc.) If it is not reflected correctly that gives you more ammo to use against them.

Send a certified letter, in it demand a full accounting, that you have been paying and you want to know the details of this debt before you pay anything further...if you looked at your credit reports and there are inconsistencies or wrong info, mention that as well.

The thing is not to be afraid of being sued. If you can only afford so much and they want to take you to court over it, let them! When a judge sees your financial situation and the fact you had been paying faithfully even if he rules in favor of them, he will still set out a payment plan you can afford, likely what you already had, if not less!

I am a bit flabbergasted at the guest post.....I have seen all kinds of posts that give detailed advice on how to do this or that, not to mention just the plain support! I have not seen any bad advice here, as those of us who post have been through these exact situations and post from actual experience.

As for speaking to a CA on the phone, it is not a good idea if you are not totally informed of your rights and you get flustered easily. BUT speaking with them (and getting them recorded) can be a great experience when you know your rights and make THEM start to stammer. The key to speaking with them is to always stand firm and do not allow them to control the conversation. A simple, "I do not recall" is great for all the questions they throw at you trying to get you to admit to debt. Admit nothing!
