Judgement against in Michigan
Date: Tue, 05/26/2009 - 08:48
While trying to get approved for a mortgage, I just found out that I have a judgement against me from 9/1/2002, from an apartment management company. I had a company transfer out of state to NC, and the manager agreed to break my lease without penalty (except forfeiture of my security deposit). I did not get this in writing. Anyhow, they apparently took it to court, and of course, since I was out of state, they won the case for $2600. I have since moved back and currently reside in the state of Michigan.
Since then the management company is no longer in business, and the apartment complex is now managed by a different company.
What can I do to get this black mark off my credit report? Do I need to pay this debt? To whom? Do I take this back to the court? Do I need an attorney? What are the statue of limitations? Who/Where do I go to fix this??
Thanks in advance,
Eric in Michigan

I'd try and dispute it first with your CRA's and see what happen
I'd try and dispute it first with your CRA's and see what happens. I would also contact an attorney in the mean time and see if you can still file a motion to dismiss baised on not being notified of the pending judgement, though truefully with it being that long ago, not sure that it would work.
I'd say that you can easily have it vacated for improper service
I'd say that you can easily have it vacated for improper service since you had moved you did not get the summons.
Even from 7 years ago? I thought there was a Statue of Limitaton
Even from 7 years ago? I thought there was a Statue of Limitatons for vacting judgement?
