bringing an action in the courtroom and sustaining a default judgement against me for a debt i am not obligated to pay...it was spouses premarital debt...motion to vacate has just been submitted by opossing party attorney after i filed complaint w/ ag & ftc literally within days of complaint...help me fill in the rest if you can...

Where do they come off even suing you for your spouse's debts in a Non-Community property state? That is an immediate FDCPA violation and you sue them in YOUR County Court. Make them travel. The grounds to Vacate would be the Affirmative Defense of Privity of Contract and the Counterclaim wold be the FDCPA violation of misrepresenting the legal character of the debt.
Go to www.debtorboards.com and you will find step-by-step instructions on how and where to sue these idiots, as well as sample Motions to Vacate and Summonses (I just got a Judgment against me vacated and that's where I posted the pleading).
