From collection agency to a low firm

I have a little dept from capital one ($1000: $500 was my credit limit, the rest is interest, late fees, etc). I got the letter from Kohn Law Firm (WI) saing that they're trying to collect this dept now (instead of Alliace One before)
I guess their next step will be taking me to court. But i'm a stay at home mom and my husband is collecting unemployment at the moment. I can't give them what i don't have. Can i be forced to sell my assets in order to pay off the dept?
I'm not sure what to do. I don't think i'm qualified for Chapter 128 since i'm unemployed.
But what about dept consolidation? Is it even worth it? We have some old medical bills all together for about $15000, but we cant start paying them all off right now..


You need to contact them and let them know. If you ignore them they will go further. I delt with this law firm and they can be a little harsh. How old is this capitol one bill. In WI the sol is 6 years+180days. But I am thinking that Kohn wouldn't take it if it was past the SOL. I am not sure how chapter 128 works, but you can call a lawyer and ask them over the phone. Let them know you do not work and your hubby is unemployed. The call is free so give it a shot. With the consolidation, if the law firm already has it then I would think they won't accept any payment from a consolidation company. Plus the consolidation company would probably tell you that with the amout of debt you have right now with no income you would be better off with a BK instead.
