I called and spoke with Capial one at the end of February. They gave me to their Recovery Dept. and stated they no longer owned the account. I was transferred to Trak america.
I sent them a certified-return receipt letter asking for Validation and about 2 weeks later receive a letter from FirstSouce saying they own my debt. So I sent a Letter asking for validation again to both First Souce and Trak America. Never heard anything from either of them.
I just received a letter yesterday from Lawyers here in Nevada. They state they are collecting for Capital One.
How can Lawyers collect for a debt that Capital one charged off in Sept. 2006 and tells me that they no longer own. How can they even represent Capital one?
What can I do about this? I am going to start by doing the validation letter that I found on this site months ago and send that to them, but I want to make sure I am doing everything I can to end this issue.
Again thank you for all the help you send my way

They cannot represent Cap1 if Cap1 no longer owns the account but they can sue on behalf of the current owners of the debt if it is still w/in SOL. CO doesn't mean you don't still owe it.

Nascar Devil,
I wanted to pay it, but when I called Capital One they said they no longer owned it and then I contacted Trak America. I sent the letter for Validate and then i received a letter from Firstsource. Who I then sent a Validatation letter, but never received one back until I just received this letter from the lawyers.
I dont have an issue paying it back. I just dont understand how a company can sue me for Capital One who States they no longer owe the debt.
What if anything should I put in a letter to the lawyers?
Your help is appreciated.

Have you pulled your free credit reports from www.annualcreditreport.com ? Cap1's tradeline should show a $0 balance with a notation of "Sold/Transferred to another lender" and there may be an entry showing who currently owns the debt. Firstsource is a JDB so it is likely they own it and retained Trak America or a DC Attorney to collect. When was the last time you paid on the account?

What if a CA owns an account, sues, but puts the name of the original creditor as the plaintiff, when in fact the CA is clearly the plaintiff? Wouldn't that be misleading the court?
