can creditors or collectors take consumers without previously contacting them to attempt to collect the debt, which was not even reported to credit report?
i've been looking for the answer if this action is violation of the law...
please someone answer it!


Yes. Not being contacted for a debt does not diminish your responsibility to repay what you have borrowed.

If your debt is real, then you have been fortunate that it hasn't yet appeared on your credit report. Hopefully you can resolve the matter before it becomes a judgment (in the event this is a legitimate lawsuit) and leaves a real nasty mark on it.

I would start out by demanding validation from the collectors, this will be highly important...

thanks.
i still do not see anything in regards to this collector or the debt on my report even after i found out they might take me to the court.
however, i found one negative with very tiny amount on the report a few days ago entered by different collector. is it possible both actually deal with the same case, but the nature of duty is different? one purchased the debt who will reported to the bureaus and one actually goes after in legal matter???
So stressful...

Two collection agencies could have the same account but that would only be if one collection agency owns it and they are out sourcing it to a sister company. I haven't seen too many of these.

What you really probably should do is make a list of your creditors who you have gotten behind on and call them to ask where your accounts are. Not all collection agencies report to the CBR's but they can't make inquries on them.
