There are many states where licensing of a collection agency is not required. They are Iowa, California, Georgia, Kansas, Montana, Kentucky, Oklahama, South Carolina and Pennsylvania.

I received a summons from Sessoms & Rogers on behalf of Sears regarding an unpaid credit card debt. I live in North Carolina and the debt is a little over $4000. I am suppose to submit my answer within 30 days but I would like to know are they licensed to collect and take me to court. I have been reading other messages stating they are not and I dont know where to look to find out if everything is legit. Oh and can anyone tell me exactly how to reply to the summons. Should I put personal informations regarding my financial status? Or should I just put that I agree that I owe the debt? I would greatly appreciate anyone that can help. Thanks

I would've looked it up for you, but I cannot seem to open any court pages for the State of North Carolina for some odd reason, but that should lead you to the right direction. You need to find the proper procedures for the county court in which you will be appearing. (I looked up "North Carolina what to do if you are being sued" in Google).
