If a Law Firm or Collection agency is not licensed in my state, can they legally pursue collections ?


how do i found out if someone is licensed in my state? they are a lawfirm collecting on behalf of someone else...which do you go by, the junk debt buyer or the law firm? also, what's the consequence for them collecting (or suing you) if they legally can't collect?

either your AG or DFI websites should be able to show a license for a CA.

if a CA is licensed in your state they abide by your state.that is why they are licensed to collect there.

I received a summons from Sessoms & Rogers on behalf of Sears regarding an unpaid credit card debt. I live in North Carolina and the debt is a little over $4000. I am suppose to submit my answer within 30 days but I would like to know are they licensed to collect and take me to court. I have been reading other messages stating they are not and I dont know where to look to find out if everything is legit. Oh and can anyone tell me exactly how to reply to the summons. Should I put personal informations regarding my financial status? Or should I just put that I agree that I owe the debt? I would greatly appreciate anyone that can help. Thanks

Here is the website for the North Carolina Court System home page. I would've looked it up for you, but I cannot seem to open any court pages for the State of North Carolina for some odd reason, but that should lead you to the right direction. You need to find the proper procedures for the county court in which you will be appearing. (I looked up "North Carolina what to do if you are being sued" in Google).

Sessom & Rogers is licensed in NC.
