I am having a problem with a creditor. My account got 2 payments behind (it has since been caught up). Initially I was sent late payment reminders in the mail and then started to get repeated phone calls at home. These calls are from the original creditor. I ignored most of the calls made to my home but my husband did answer several and told them he would let me know they had called. They were calling my home 2-3 times a day. These calls included calls from a business line and also calls from a cell phone (which did not identify the business or caller on caller ID). One call to my home was made from the cell phone at 750am. My husband spoke to one caller who told him if I did not respond to their calls then he would come to our home. After the calls to my home were unsucessful the creditor starting calling me at work. When I did speak w/ the creditor at work I told him I would get the account caught up on my next pay day (about 1 1/2 weeks away). I was told that was not going to be soon enough. When I told the caller that it would have to be then he told me that he would be coming to my house to discuss this further and that he would take me to court. I told the caller that he was not to contact me and work again or come to my home. The calls at work stopped for a day or two then resumed. I received another call at work and I talked w/ the creditor on the Wednesday following the Friday pay date (in which I had told them that I would make my payment). When I spoke to him on Wednesday I assured the caller that the payment was mailed out of Monday and should be received by them in the next day. The creditor came to my home that same night even though I had already spoke to them by phone that same day and reassured them that a payment was on its way. Due to the repeated calls at work and now a home visit I sent a certified letter to cease communications with me regarding this account. I advised the creditor that any future communications with me should be done only in writing. I have received the return receipt for this letter but when I came home today I had a message on my answering machine from them requesting a call back. At this point I do not know what to do. My account is current (they did receive and cash my payment that had been sent). Can they still call me after I have sent a cease communications letter (especially given the fact that the account is now current)? What should I do??


It doesn't sound like she paid them off, just that she brought the account current by making her past-due payments.

C&D letters are not effective to an original creditor, they don't have to honor those requests. Only a CA is bound by the fdcpa.

There's a few possibilities ... maybe whoever called recently didn't realize your payment was posted? They work off call lists and they could have made the call without looking at the account.

Or they may be calling for another reason? If your account is indeed current, maybe you should return the call to ask them why they're calling? Get the situation straightened out and then the calls will stop.
