I have a quick question about collection companies. In order to collect, do they have to be licensed in your state? If so, is there somewhere I can look this company up to see if they are licensed?

I'm in California. I'm wondering because I'm waiting on a vlaidation letter from them. :D


I got a call tonight from this company and spoke with a man named vic shaw. he said that it was for a payday loan and that if i don't pay it that i'll have to call the IRS and file on the loan and pay taxes on it. Either I will or they will he said "You sound like the kind of person who would do that" LMFAO

So I'm also wondering what he's taling about with the IRS forms n such. I know it's probably a scare tactic but these guys irritate me.

CA has come down hard on the internet pdls that are not licensed in your state read this press release:

If this is the case with your internet pdl, well either way, file a complaint with your AGs office and the dept. which is going after these guys. They have over 40 companies they have issued cease and desist orders on and they have to payback the consumers.

The loan was from Rio Resources but it was sent to unitedl legal for collection.

Correct me if I am wrong, but I don't think that most states require a collections license. In past collection letters I have received, there are disclaimers for certain states: Colorado, Minnesota, New York, North Carolina, Tennessee.

Good news for you, Jolie:
California appears to have its own fdcpa called the Rosenthal Fair Debt Collection Practices Act. Google it and you should come up with the info you are searching for.

ever since their call and my asking them to validate that they have the account and can collect on it, I got no response from them other than from the BBB stating that they have no record of me ever borrowing money from them. I have also not received anymore calls from united legal.

Jolieeee - well, it looks like maybe you have made them see the light if they aren't calling, but sometimes these companies are like cockroaches - they scurry away when lights are turned in their direction, highlighting their activities, and when they think it's dark and safe again, they come back out of the woodwork.

Sorry for the nasty analogy, but it's all I could think of. LOL

And as far as them reporting to the IRS, I would say that's a very empty threat. Think about this - in order to report this to the IRS, they would have to have a Federal ID number, which means they would have to be paying payroll taxes, state taxes, filing reports with the state, etc. Which means they would also have to be licensed with the state. I'm pretty sure none of the above is being done, or they would have "reported" a huge number of people to the IRS. I have yet to see that happen to anyone over a Payday Loan.
