I received a call from a Justin at LRA... he actually called my old employer and a friend relayed the message to me. He stated that I owed $444.13 on an internet payday loan that I took out in August of 2009 with National Payday Loans.

I have not received ANY written notices about this matter and they have a BBB rating of F.

I want to send a C&D letter, as well as a DV letter. I tried to fax the C&D letter last night but the fax told me that number was not valid.

I honestly have no idea if I ever paid back the loan with National Payday Loans. I am in Illinois and I'm pretty sure these types of loans are illegal. I don't have the means to pay
$444 on this loan, which I'm sure was in the original amount of $300.

Should I contact National Payday Loans directly?

Any suggestions on how to deal with this CA?


First things first--get a WRITTEN statement from your friend that took the call where you used to work. This debt collector broke the law when they disclosed information to him about this matter.

Second, do not send a cease and desist letter yet. Send them a certified DV request letter first. If you send a C&D, they will not legally be able to contact you to send you validation.
