Really, LVNV is like whack a mole. They give the account to one collection agency, I send the dv/partial cease comm letter, then, presto, they send it to yet another agency. Rinse and repeat.

They started with Leading Edge, then another (forgot name), and now I'm getting calls from Richard Boudreaux, an atty in NH - maybe.


Did you include LVNV's name on the DV's/Partial C&D's you sent to any of the CA's? Even if you didn't, from what you described, LVNV is aware of what they're doing, and trying to get around your DV's, by pulling the account from one CA and moving it to another CA like that.

I'm currently suing Pinnacle for doing this exact same thing. They had an account and NAFS. When I DV'd NAFS, they sent one of those lame "statements" on their letterhead claiming it was proper validation. I sent a response back to NAFS advising that wasn't proper validation, they should try again. So Pinnacle pulls the account from NAFS and placed it with The Law Offices of Thomas Landis.

So now, my attorney is dealing with them for me regarding multiple FDCPA and FCRA violations. As well as violations of the Florida Consumer Collection Practices Act.

Yeah, they're a real bad apple. According to Consumer Advocate Extraordinaire Bud Hibbs ("http://budhibbs.com/collectorpages/LVNV.htm") they are one of the worst in the nation. Have you sent a dispute to the credit bureaus yet? If not, do so. It will strengthen your case should you ever decide to go the route of suing.
