LVNV: waiting and waiting..

However it was at this same time I was first contacted about a debt with LVNV. I received a dunning letter in Nov 2008 from Leading Edge followed by a dunning letter dated Dec 10, 2008 from Resurgent.
Because of canceling with CNI and not really knowing what I was doing (I think I had just found this site around this time..I'm smarter now..ha ha) there was never a DV sent out on this.
Jump to now, over a year since I received the notice from Resurgent. I have not received any further written communication from LVNV, Resurgent or any other collection agency on this account. I get an occasional phone call from various 866#'s (they seem to have a lot of them), but they have never left a message this entire time. Sometimes it will be a few days between calls, sometimes maybe a week and a half. They have never called more than once a day either.
I know LVNV is on my credit report and the balance increases monthly with the added interest. Current balance is around $4,700.
I signed up with a legal plan though work this year, so now if I need an attorney I can get one. I'm basically waiting for the summons to show up so I can go talk to an attorney, go to court and make LVNV prove I owe them this money.
I'm just very surprised they have not been more aggressive. No written communication in over a year and only an occasional call. They are not even harassing me with numerous collection calls a day, calling relatives, etc., like everyone else did..ha ha..
Any ideas why LVNV/Resurgent would be taking a slow/low key approach? I'm sure $4,700 is worth suing someone over. :cool:

I think I have dealt with at least 5 of their companies. They don't play fair and you need to keep notes of calls, and if you get correspondence.
Knowing what I know about them I would check with your local court clerks office from time to time to make sure they haven't filed suit. I know they have done that in the past, with people not knowing they were doing this.
Usually one of their last resorts is to have WW&R a law firm/collection agency try to scare the pants off you.
Shazzers is right, read up on them and their many agencies to see how others have handled them. If they do contact you via letter, come back and let us know and we can direct you from there. Maybe you will get lucky and they will "loose" your account!!..karen

I'm wondering if they are waiting for the "dust to settle" on not only me personally but the economy as a whole. The SOL is 6 years in MN so they have plenty of time. Maybe they see all the settled for less than full balance on my credit report and think that by waiting I'll have more money available.
However, they probably would have been better off hitting me hard when I was really down and out a year ago rather than waiting. Likely would have gotten a default judgment against me like Citibank did since I didn't know what I was doing and had no money to settle anything.
But now that I'm wiser, have most of my accounts fully settled and have access to an attorney if I need one they won't get anything without seeing me in court. I won't be rolling over on this one once they decide to become more aggressive.
