Summons request by Machol & Johannes, LLC - Colorado
Date: Thu, 10/22/2009 - 08:29
So I have just been summoned to answer a civil complaint about a past debt I owe to Washington Mutual by Machol & Johannes, LLC of Denver, CO. I've read some pretty deragatory things in this forum about this agency and how they have repeatedly violated the fair rights act, etc. This is the first real contact they have had with me regarding an account that I thought had been charged off. My first approach, I'm thinking, is to send them a validation letter requesting validation of the debt I owe, their right to collect this debt on behalf of WAMU, etc. Should I also file a response to the summons? Or wait to see if they reply accordingly with the requested documentation? The summons date is not until November 17th, which sounds far away, but I know these things can sneak up on you if you're not prepared. And if this agency fails to respond adequately and violates the fair rights act, can they still proceed with the court summons? Can someone help enlighten me on this process and the best way to approach this matter? From reading the forum it definitely sounds like the first thing to request is validation from Machols & Johannes. But don't know about the summons in correlation to a response regarding the validation. Confused? Me too. Any help is appreciated. Thanks!

Were you served by the local authority or by the collection agency? I'd have checked with the country court to see if there is indeed a lawsuit pending in my name.
Since the summon is a legal doc, you might not miss the date to file an answer. Along with it you may also file the 'motion of discovery' which would reveal all facts regarding the debt. You may also send the debt validation letter to the CA.
You can refer to the following site to file your answer for the summon.
