Here is my situation. I had a credit card with Newport News in the early 2000's. I was behind on my payments and I called and got a payoff amount and mail them their last payment with a cashiers check. My check was dated 7/3/02. It cleared the bank of 7/17/02. Also, included with my payment was a letter that my account per our conversation would be paid in full. On April 16, 2008, I received a call from Mann Bracken, LLC regarding this matter. I faxed them a copy of the letter and check and thought this was taken care of. Today, I was served with papers where they have filed suite against me. Where do I go from here.


Tammy...please try to keep this in a single thread. First thing is you must answer the summons or they win by default. What did they send with the summons? A questionaire, Request for Discovery, interrogatories? Do you have all the documentation from the paid off debt? Did you request debt validation from Mann Bracken prior to the summons? If I remember correctly you live in GA and are subject to a 6 year SOL so SOL would be your defense but we want to make sure that you are prepared for any evetuality. There was no other supporting paperwork just where they had filed suite (I received this yesterday). I have a copy of the letter and check that was sent to the original creditor. I have not requested anything from them. Should I contact them or hire an attorney?
