Yesterday I received a summons from Mann Bracken, which I validated with the court. It is for an account that I owe approximatley $18,000 to HFC. It says I have 30 days from the date I receive it to respond. Any suggestions as what I should do now? Should I send a DV letter immediately? After I do that, then what? Any help is appreciated.


After getting stuck in the PDL trap, and never having any money left from my paycheck all of my bills have gotten behind over the past year. I have been looking for a way to pay them so I didn't have to file BK. I feel so stupid sometimes and I really don't want to file BK but I just don't see any way out of it. Mann Bracken continues to call me on a regular basis even though they've already served me. Do you think I call them back now or wait until I have seen the attorney on Monday and let them know about the BK?

Let them know the case number as soon as you have it. The filing date is the date you turn the paperwork in to the courts and the automatic stay takes precedent immediately. So you can either speed up the process of completing the paperwork so you can file immediately, or go ahead and respond to the summons. Court dates are usually set some time in advance. Next will come the Case Management Conference which is usually scheduled around 4 months later (according to "http://www.gianelli-law.com/article9-NTL-whathappens.html") so you have plenty of time to get your Bankruptcy paperwork together.
